Questions & Answers

Does the settlement cover all Tom’s toothpaste products?

What products are included?

  • Any Tom’s toothpaste product bought during the class period counts as a Class Product. The notice does not limit the settlement to particular toothpaste varieties, sizes, or product names.
  • The purchase must have been for use, not for resale or distribution.

What are the limits on the cash awards?

The notice sets different limits depending on whether the claim includes proof of purchase.

  • The no-proof payment is limited to up to one claimed product per household.
  • For that payment, the amount is based on the average manufacturer’s suggested retail price (MSRP) for the product during the class period. The notice does not give a dollar amount.
  • With proof of purchase, the claim can seek the documented amount paid for up to three products.

Why could my payment be lower than the amount described?

The $2.9 million is a total settlement fund, not a guaranteed amount reserved only for customer payments.

  • The $2.9 million fund also pays settlement administration and notice costs, required CAFA notice, any court-approved lawyers’ fees and service awards, as well as class-member claims.
  • If approved claims are greater than the amount available for class-member payments, each cash payment will be reduced proportionally.
  • If approved claims are lower than the amount available for class-member payments, the remaining money will be donated to Equal Justice Works.

What do I need to do to receive a payment?

A claim is required even if you are part of the settlement class.

  • You must submit a valid claim to receive a payment. Doing nothing does not result in an automatic payment.
  • You may submit a claim online, or print a form and mail it to the Class Administrator.
  • A mailed form must be completed, signed, and postmarked by July 6, 2026. An online form must be submitted by that date.
  • The notice does not state what documents qualify as proof of purchase or describe online form certification requirements.

What happens if I opt out of the settlement?

Do not opt out if you want to remain in the settlement and seek a payment.

  • Opting out means leaving the settlement. You will not receive a settlement payment, but you keep any right you may have to separately sue the defendants about the legal issues covered by this case.
  • To opt out, mail a Request for Exclusion to the Class Administrator. It must be personally completed and submitted by you or your attorney, and it must be postmarked by July 6, 2026.
  • If an attorney submits the request, you must personally sign it or separately declare that you authorized it. You cannot opt out another person.

How can I object instead of opting out?

Objecting asks the Court not to approve some or all of the settlement. It is different from opting out.

  • You can object only if you remain in the settlement; someone who opts out cannot object.
  • A written objection must identify the case and the document as an objection, provide contact and class-member information, explain the objection and its supporting facts or law, and include the required signatures.
  • You must electronically file the objection through the Court’s ECF system or deliver it to the Clerk of the Court by July 6, 2026. You may still file a claim if you object.
  • You may speak at the hearing about an objection, but advance notice of intent to appear is requested, not required.

When might payments be sent?

The settlement is still proposed. Payment timing depends on final approval and any appeal process.

  • The hearing is scheduled for September 10, 2026, in Courtroom 1020 at the Central Islip Courthouse.
  • The Court will decide whether the settlement is fair and whether to approve requested attorneys’ fees and service awards.
  • You do not have to attend. The hearing date and time may change.
  • Payments are not due merely because the hearing date passes. They can be distributed only if the Court grants final approval and after any appeals are resolved.

What happens if I do nothing?

Remaining in the settlement without filing a claim still affects your legal rights.

  • If you stay in the settlement and take no action, you will not receive a payment.
  • You will also give up the right to bring, continue, or participate in another lawsuit against the defendants about the legal claims resolved by this settlement.
  • The full list of released claims is in the Settlement Agreement, not in this notice.
