Bestway Spa Pump Class Action Settlement

Receiving a notice does not itself decide membership. The notice says you are a class member if you meet the class definition, whether or not you received notice.

• You must be in the Settlement Class: a person in the United States who bought one of the listed Bestway AirJet or HydroJet spa-pump models during May 2021 through May 2024.
• Judges presiding over the cases, their family members, Bestway and its affiliated entities, and their officers and directors are excluded.

The warranty extension applies to the replacement pump, not necessarily to the original product.

• If you received a replacement pump through the Spa Pump Recall, the one-year extension to the Bestway Limited Warranty is automatic. You do not need to submit a claim for that benefit.
• Cash payments are a separate benefit. A claim must be submitted for cash, even if you received a cash payment in the recall.

The notice describes the cash benefit as an additional payment for people who received a recall cash payment. It does not say that receiving a replacement pump alone qualifies someone for the additional cash payment.

• You may qualify for up to $75 if you received a cash payment in the Spa Pump Recall and submit a valid claim by October 5, 2026.
• You may also qualify if you no longer have the covered pump and submit a valid claim with valid proof of purchase by that date.
• If you still have a covered pump and have not taken part in the recall, you must participate in the recall before receiving settlement benefits.

The notice does not further define what documents will be accepted as valid proof of purchase for a cash claim.

• If you no longer have the covered pump, include valid proof of purchase with your claim form.
• The notice does not state that proof of purchase is required from a person seeking the additional payment after receiving a cash payment in the recall. However, every claim is reviewed to determine eligibility.
• A signature, declaration, or notice alone is not identified as proof of purchase for the no-longer-have-the-product route.

A timely submission does not guarantee payment; the Settlement Administrator will review claims and determine eligibility.

• Submit the claim online by October 5, 2026.
• If you still have the pump and have not already participated in the recall, complete the recall first.
• The notice gives an online claim method but does not describe a mail-in claim procedure.

The notice does not say in advance what the final payment amount will be.

• The stated cash payment is up to $75, not a guaranteed $75.
• Cash payments and plaintiff incentive awards share a $2,000,000 cap.
• If timely valid cash claims plus those incentive awards exceed the cap, each cash payment will be reduced proportionally.
• If the Court awards less than the requested attorneys’ fees, expenses, or plaintiff incentive awards, the unawarded amount will be divided proportionally among valid cash claimants.

The notice does not provide a specific payment date. The final approval hearing is scheduled for November 4, 2026, but the Court's decision and any later payment timing are not stated.

• Eligible settlement payments will be sent by mailed check or electronic payment.
• They will be sent only after the settlement is approved and becomes final.

The notice directs readers to the Settlement Agreement for the full description of the claims being released.

• If you do nothing, you will not receive a cash payment.
• If you received a replacement pump in the recall, the warranty extension is still automatic.
• Unless you exclude yourself, you give up claims against Bestway and listed affiliates concerning the covered products if the settlement is approved and final.
• Claims for personal injuries and property damage other than damage to the covered product are expressly not released.

A person who opts out receives no settlement payment.

• To opt out, meaning to leave the settlement and keep your own right to sue over the issues in this lawsuit, mail a signed written exclusion request postmarked by October 5, 2026.
• The request must include your name and mailing address, a clear request to be excluded, the case name and number, and your signature or that of an authorized person.
• An exclusion request must be for an individual class member, not a group.

The notice says an objection can ask the Court to deny approval, but cannot ask the Court to impose a different settlement.

• You may object or comment only if you are a class member and have not opted out.
• An objection or comment must be filed with the Court and also served on both Class Counsel and Defense Counsel by October 5, 2026.
• The notice requires detailed information, including proof of purchase, a sworn statement about the purchase, the grounds for the objection, and other listed materials.
• You may still file a claim and receive a payment if you object or comment.
