Who Is Included

Living U.S. residents whose Private Information may have been accessed in the Data Incident, including people sent notice by OnePoint that their information may have been impacted, subject to the stated exclusions.

  • Proof required: For documented losses, provide reasonable documentation such as telephone records, emails or other correspondence, or receipts; personal certifications, declarations, and affidavits alone are not reasonable documentation. The alternate cash payment does not require loss documentation, but a timely and valid Claim Form is required for benefits.

Who may be part of the settlement?

Who is included, and who is excluded?

  • You may be included if you are a living person living in the United States whose private information may have been accessed in the incident. This includes people who received a OnePoint notice saying their information may have been affected.
  • You are not included if you are among the listed OnePoint-related entities and personnel, the assigned judge’s immediate family or court staff, someone who validly opts out, or someone found guilty of—or who pleads no contest to—causing or helping cause the incident’s criminal activity.

Should I choose documented losses or the alternate cash payment?

What payment choices are available?

  • Cash Payment A: You can seek up to $3,500 for losses related to the incident if you provide reasonable supporting records.
  • Cash Payment B: Instead of Payment A, you can claim an estimated $100 without loss records.
  • The two cash payments are alternatives, not payments you can receive together. Either cash payment can go up or down by the same percentage depending on the total value of valid claims and money available in the Net Settlement Fund.

What records do I need for the up-to-$3,500 payment?

What proof is needed for a documented-loss claim?

  • Examples include phone records, emails or other correspondence, and receipts.
  • Your own certification, declaration, or affidavit does not count as reasonable documentation by itself, although it may help explain other records.
  • You cannot be paid again for an expense already reimbursed from another source, including certain protection products supplied with the Defendant’s notification letter.

What if I cannot support my documented-loss claim?

What happens if my documented-loss claim is not accepted?

  • If you do not submit adequate loss records, or the administrator finds your claim invalid and you do not fix it, the claim will be changed to the alternate cash-payment claim.
  • The notice describes the alternate cash payment as an estimated $100 payment without documentation.

How and when do I file a claim?

How do I submit a claim, and what is the deadline?

  • A timely, valid Claim Form is required for either cash payment.
  • You may submit it online by October 8, 2026, or mail it to the Settlement Administrator. Mailed forms must be postmarked by October 8, 2026.
  • The notice lists the administrator’s mailing address as PO Box 2688, Portland, OR 97208-2688.

Will security improvements reduce the money available for claims?

Does the settlement include security improvements?

  • The Defendant says it is implementing additional security measures after the incident.
  • Those measures are paid for by the Defendant and do not reduce the settlement fund.

When will I receive a payment?

When would payments be sent?

  • Benefits are not provided unless the Court approves the settlement and it becomes final.
  • The notice does not give a payment date. It says this process may take time.

How can I leave the settlement instead of participating?

How do I opt out, and what does it mean?

  • To leave the settlement, mail a written exclusion request postmarked by August 24, 2026. It must give your name, mailing address, telephone number, email address if you have one, your physical signature, and a statement that you want to be excluded.
  • You cannot opt out by telephone or email.
  • If you opt out, you cannot receive settlement benefits, but you will not be bound by the settlement or its judgment.

How do I object to the settlement?

What is required to object?

  • You may object only if you stay in the settlement; you cannot both object and opt out.
  • A written objection must be filed with the Court by August 24, 2026. By that same date, it must also be mailed or sent by qualifying private courier to Class Counsel, Defendant’s Counsel, and the Settlement Administrator.
  • The notice requires detailed information, including proof of class membership, the grounds for the objection, specified information about prior objections, and your signature.

What happens at the final approval hearing?

When is the Court hearing, and do I need to attend?

  • The hearing is scheduled for September 23, 2026, at 1:30 p.m. at the Gene Snyder United States Courthouse, 601 West Broadway, Louisville, Kentucky 40202.
  • You do not have to attend. If you filed a timely objection and asked to speak, the Court may hear you or your lawyer.
  • The date, time, and format can change.
