Who is included, and who is excluded?

Being sent the notice does not replace the class definition. The notice says Anthem identified recipients as people who sought Anthem coverage and were denied, but the formal class definition is the group identified by Anthem in discovery whose PBRT treatment for prostate cancer was not covered by insurance.

If you are unsure whether you are included, the notice provides contact information for the Settlement Administrator.

  • The Settlement Class is limited to people Anthem identified in discovery who received proton beam radiation therapy (PBRT) for prostate cancer and whose treatment was not covered by insurance, including insurance other than Anthem.
  • The notice excludes the judge handling the case and that judge’s immediate family and staff; Anthem employees and their immediate families; Class Counsel employees and their immediate families; and people who validly opt out.

What expenses can be used to determine my payment, and is there a set amount?

The notice does not promise a fixed payment amount or state a percentage of expenses that will be repaid. Payments come from the remaining settlement fund after the listed deductions.

What must I submit to seek a payment?

A claim is required. The notice says forms may be printed from the settlement website and mailed to the address printed on the form.

  • Submit a Claim Form by mail.
  • Include the supporting document required by the Claim Form.
  • The document must show the provider’s name and address, service date, description of services, and provider charges that you paid out of pocket.
  • The mailed Claim Form must be postmarked by October 10, 2026.

What happens if I do nothing?

Doing nothing keeps an eligible person in the settlement, but it does not submit a claim. A Claim Form is necessary to seek a payment.

  • You will not receive a payment from this settlement.
  • If the settlement is approved and becomes final, you will be bound by its release. That means you cannot bring, continue, or join another lawsuit against Anthem or the released parties over the matters the settlement resolves.

How do I opt out, and what does opting out change?

Opting out means leaving the settlement. You will not receive settlement benefits, but this is the option that preserves your ability to pursue your own lawsuit concerning the released claims.

  • Send a written opt-out request to the Settlement Administrator.
  • Include the case name and number, your signature, a clear statement that you want to opt out, and your name, address, and telephone number. Include your lawyer’s contact information if you are represented.
  • The request must be postmarked by July 27, 2026.

How is objecting different from opting out?

The notice lists detailed information and materials that an objection must include, including your reasons, contact information, signature, and certain information about prior class-action objections. It also explains how to request permission to speak at the hearing.

  • An objection tells the Court why you disagree with the settlement or part of it; it does not remove you from the settlement.
  • To object, file a written objection with the Court and mail copies to Class Counsel, Defense Counsel, and the Settlement Administrator.
  • The objection must be filed and postmarked by July 27, 2026.
  • An opt-out request and an objection are different: a person who opts out cannot object because the settlement no longer applies to that person.

When will the Court consider approval, and when could payments be sent?

The hearing is when the Court will consider whether the settlement should receive final approval, as well as requested attorneys’ fees, costs, and service awards. The notice does not give a specific payment date.

  • The Final Approval Hearing is scheduled for August 19, 2026, at 2:00 pm, at the United States District Court for the Middle District of Tennessee, 719 Church Street, Suite 1300, Nashville, Tennessee 37203.
  • You do not have to attend the hearing.
  • Benefits will be distributed only after the settlement is approved and becomes final. Appeals, if any, can delay that timing.
