Questions & Answers
Who is included in the Settlement Class?
The notice says recipients are Settlement Class Members based on NFCU’s records. The class definition has several requirements, so receiving the notice does not change those listed conditions.
- You must have been an NFCU member who was provided a personal loan between January 1, 2023, and January 31, 2025.
- The loan application must have come from a device NFCU did not recognize, and NFCU must have deposited the loan money into your account.
- You must have disputed the loan with NFCU as fraudulent, NFCU must have denied that dispute fully or partly, and NFCU must not have recovered all of the loan funds.
What happens automatically if I stay in the settlement?
These three forms of relief are automatic for Settlement Class Members. You do not need to submit a Claim Form to receive them. The notice separately offers a possible additional $250 payment through the Claim Form process.
- NFCU has canceled or will cancel the qualifying loan balance.
- NFCU has requested or will request deletion of credit reporting related to the loan.
- NFCU has reimbursed or will reimburse payments made to NFCU on the loan, including offsets initiated by NFCU.
How will the automatic refund be sent?
The automatic refund covers payments made on the qualifying loan, including offset payments initiated by NFCU.
- The notice lists the refund amount for payments you made on the loan in your individual notice.
- If you have an NFCU deposit account, the reimbursement will go to that account.
- If you no longer have an NFCU deposit account, the reimbursement will be mailed by U.S. Mail to the address that received the notice.
How do I seek the additional $250 payment?
The notice says the additional payment is $250 and says it will go to an NFCU deposit account. If you no longer have one, it says the $250 payment will be mailed by check to the notice address. The supplied notice text does not include the referenced Claim Form, so its full instructions cannot be confirmed here.
- Complete and sign the Claim Form.
- Mail it to Edey v NFCU, c/o Settlement Administrator, PO Box 23668, Jacksonville, FL 32241, or submit a Claim Form through the settlement website.
- For a mailed claim, the notice gives a postmark deadline of November 29, 2026.
What does opting out mean, and how do I do it?
Opting out means leaving the settlement. It is different from objecting: an objection asks the Court to change or reject the settlement while you remain in it.
- Send a written Request for Exclusion to the Settlement Administrator at the notice address, postmarked by November 9, 2026.
- Personally sign the request and include your name, address, telephone number, and a statement asking to be excluded from this settlement.
- If you opt out validly and on time, you will not receive monetary payments from this settlement, cannot object to it, and keep the ability to pursue your own individual claims at your own expense.
What rights do I give up if I remain in the settlement?
A release is the legal term for claims you agree not to bring as part of staying in the settlement. The notice says the detailed release terms are in the Settlement Agreement.
- If the settlement receives final court approval and you do not opt out, you give up claims against NFCU arising from or relating to the qualifying personal loan, including claims you do not know about.
- The notice specifically says you do not release an actual-damages claim under 15 U.S.C. § 1681s-2(b) of the Fair Credit Reporting Act.
How can I object, and when is the court hearing?
You may object only if you remain in the Settlement Class. The final approval hearing is scheduled for December 9, 2026, at 12:00 p.m. in the United States District Court for the Eastern District of Virginia in Norfolk, Virginia. You do not have to attend.
- A written objection must be filed with the Clerk of Court by November 9, 2026.
- You must also send a copy to the Settlement Administrator.
- The notice lists required information and materials, including your contact information, specific reasons for the objection, and information about planned witnesses or exhibits.
Will lawyers’ fees or awards to the named plaintiffs reduce my relief?
You do not owe Class Counsel anything directly under the notice. You may choose to hire your own lawyer, but would be responsible for that lawyer’s fees and expenses.
- Class Counsel plans to ask the Court for $250,000 in attorneys’ fees and expenses.
- The Named Plaintiffs may seek service awards of up to $15,000 each.
- The notice says any amount the Court approves for these requests will be paid separately and will not reduce Settlement Class Member relief.
