Pennsylvania medical-record fee settlement

This proposed settlement concerns allegations that HealthPort, now Datavant, overcharged for certain Pennsylvania medical-record requests. Eligible Class Members who file a valid claim may receive 35% of qualifying basic, search and retrieval, and per-page copying fees they paid. Who Is Included

The settlement covers certain people and entities sent Mail Notice who requested, or served a subpoena for, medical records from a Pennsylvania healthcare provider or facility and paid HealthPort Technologies LLC or its subsidiaries the maximum listed statutory basic, search and retrieval, and/or reproduction fees between July 15, 2005 and September 3, 2012. Important exclusions apply, including requests not requiring patient authorization, radiological-image requests, certain insurance audit requests, healthcare providers or facilities, governmental entities, and specified counsel and Court-related persons.

  • Proof required: Submit a completed and signed Proof of Claim. The administrator records list ordinary claim transactions and benefit amounts, but the notice does not establish that documents can never be required; successor or beneficiary claims may need additional validation information.

Claim and Payment Information

Questions & Answers

Who is included in the settlement, and who is excluded?

Some requests are excluded. Examples include radiological-image requests, insurance-company audit requests made under a written contract, requests by healthcare providers or facilities, and requests by government entities. Requests that did not require patient authorization, or where the maximum listed fees were not both charged and paid, are also excluded.

  • The settlement class includes certain patients, representatives, designees, insurers, lawyers, law firms, and others who served subpoenas without being designated by a patient.
  • The request must have been made to a Pennsylvania healthcare provider or facility. HealthPort Technologies LLC or a subsidiary must have charged and been paid the maximum applicable basic, search-and-retrieval, and/or reproduction fees during the stated 2005–2012 period.
  • The notice also limits the class to people or entities who were sent Mail Notice.

How is the payment amount calculated?

  • For each qualifying record request, the benefit is 35% of the qualifying basic fees, search-and-retrieval fees, and/or per-page copying fees that were paid.
  • The payment is based on HealthPort/Datavant’s records of amounts invoiced and paid. It is not a flat payment shared equally by all class members.
  • A payment depends on a valid, timely claim, final court approval, and the resolution of any appeals.

What do I need to do to seek a payment?

  • Complete and sign a Proof of Claim and submit it online or by mail. The completed claim must be received by November 30, 2026; a mail postmark alone is not enough.
  • Patients who requested their own records, and people who requested records for a patient for non-commercial purposes, were sent a claim form with their mailed notice. Other non-patient requestors must use the settlement website to access their form.
  • The website claim form lists the transactions attributed to the class member in HealthPort/Datavant’s records, including invoice and payment information and the benefit amount.

Do I need documents to support my claim?

  • The notice requires a properly completed and signed Proof of Claim for all claimants.
  • For an ordinary Class Member, the notice does not state whether the claim form requires supporting payment records or other documents. The notice says HealthPort/Datavant transaction information is already listed on the claim form.
  • Someone claiming as a Patient Requestor Beneficiary or Successor Settlement Class Member may be asked for additional information to validate the claim.

What if the listed class member is a former law firm, business, or another person?

  • A Patient Requestor Beneficiary or Successor Settlement Class Member is someone who learns of a notice sent to a proposed class member and certifies on the claim form that they hold all rights to that person’s settlement benefit.
  • The notice gives examples where a person may believe they have that right, such as when the identified class member was the person’s former law firm, business, or company.
  • The administrator may require additional validation information for this type of claim.

What if I was reimbursed for the records fees?

  • If someone else reimbursed you for the records payment, the notice says you should consider whether that person or entity is entitled to the settlement benefit.
  • The notice specifically cautions that an attorney reimbursed by clients may have an ethical obligation to place settlement benefits in a client trust account and return the money to clients.

How do I opt out, and what does that change?

  • To leave the settlement, send a written exclusion request by First Class Mail. It must be received by the Settlement Administrator by October 1, 2026.
  • The request needs the case reference, Notice ID, your capacity in the settlement, contact details, a statement that you want to opt out, and a signature. Beneficiary or successor requestors must also briefly explain why they claim that status.
  • If you opt out, you cannot receive a settlement payment or object to the settlement. You will not be bound by this case’s outcome.

How can I object or speak at the court hearing?

  • You may object only if you remain in the settlement class. A written objection must be received by the Court, Class Counsel, and Datavant’s counsel by September 16, 2026.
  • The objection must identify the case and the objector, explain each objection, state whether it concerns the individual, part of the class, or all of the class, and say whether the person plans to attend the hearing.
  • The fairness hearing is scheduled for October 16, 2026, at 9:00 AM in Room 816 of the City County Building, 414 Grant Street, Pittsburgh. The Court will decide whether to approve the settlement after the hearing.

What happens if I do nothing?

  • If you do nothing, you will not receive a payment.
  • Unless you opt out, you will still be bound by the settlement if it is approved. That includes giving up claims against HealthPort/Datavant that were or could have been raised in this case.
  • The notice says the detailed list of released claims is in the Settlement Agreement.

Will lawyers’ fees reduce class-member payments?

  • Datavant will pay Class Counsel’s fees, costs, and expenses separately from the settlement relief available to class members.
  • Class Counsel plans to ask for up to $1,620,678 in attorneys’ fees, $32,500 in costs and expenses, and a $25,000 payment to David Landay for serving as Class Representative.
  • The Court may award less than requested. The notice expressly says attorneys’ fees, costs, and expenses will not be taken from funds for class-member payments.

When might payments be sent?

  • The Court will first decide whether to approve the settlement at the October 16, 2026 hearing.
  • Even if it is approved, appeals may follow. The notice says resolving them can take time, perhaps more than a year.
  • The notice does not give a specific payment date.
