Natera Panorama and Horizon Test Settlement: Who Can Claim

The proposed settlement resolves claims about how Natera communicated the price of its Panorama prenatal test and Horizon carrier screening. People billed above the settlement's thresholds can claim a share of the $9,500,000 fund based on what the company's records show they paid; claims are due May 3, 2027.

Questions & Answers

How is my payment category determined?

Which payment category applies depends on whether Natera’s records contain proof that you paid more than the threshold for the applicable test. A valid Claim Form is required either way.

  • Your payment category depends on Company records, not on a choice between two payment options.
  • If Company records show qualifying out-of-pocket payment, you may receive a pro rata share of 94.7% of the Net Settlement Fund. That share cannot be calculated in advance because it depends on valid claims and the funds available.
  • If those records do not show qualifying payment, the notice describes a payment of no more than $50, subject to the available Net Settlement Fund.
  • The notice says people in the first group received a notice ID beginning with “A,” while those in the second group received an ID beginning with “B.”

Do I need documents to submit a claim?

A Claim Form is required to seek money. The text supplied with the notice says a copy of the form is attached, but that form is not included here. For that reason, the notice text alone does not establish what documents, if any, the form asks you to provide.

  • Complete and submit a Claim Form online by May 3, 2027, or download, print, complete, sign, and mail a form so it is received by that date.
  • The notice does not state whether the Claim Form requires you to submit receipts, bills, or other payment records. It says Natera’s records determine which payment category applies.
  • A signature, claim number, or notice ID is not described as proof of payment.

Why is the $9.5 million fund not the amount paid directly to claimants?

The $9.5 million is not the amount that will be divided directly among claimants. The Court must determine the fee, expense, and service awards.

  • The settlement’s money fund is $9.5 million, but deductions come out before payments to claimants.
  • The deductions include notice and administration costs, any attorneys’ fees and expenses the Court awards, and any service award the Court awards to the plaintiff.
  • The remaining amount is called the Net Settlement Fund. The 94.7% payment pool and the up-to-$50 payment are both subject to the funds available.

Is there a limit if I also participate in the NIPT Case settlement?

The notice identifies the other case as In re Natera Prenatal Testing Litigation, Case No. 4:22-cv-00985-JST in the Northern District of California.

  • The notice says a payment in this settlement plus a payment in the separate NIPT Case cannot exceed your out-of-pocket payment or payments for the applicable Genetic Screening Test or Tests.
  • This restriction applies only to a claimant who participates in both settlements.

What claims do I give up if I stay in the settlement?

Staying in the settlement—including doing nothing—has legal consequences even if you do not receive a payment. Leaving the settlement by the opt-out deadline is the option that preserves your ability to bring your own lawsuit over the claims released here.

  • If you remain in the settlement and it is approved, you give up claims against Natera and related parties based on the facts and claims in these cases, including claims concerning such matters as pricing, billing, insurance billing, and patient payment obligations for the Genetic Screening Tests.
  • Personal-injury claims are excluded from the release.
  • The release does not include claims asserted in the separate NIPT Case.
  • You retain defenses or counterclaims if a released party brings a collection action concerning Genetic Screening Tests performed during the class period.

What is the difference between opting out and objecting?

Opting out means leaving the settlement. It is different from objecting: an objection tells the Court what you disagree with, while opting out removes you from the settlement.

  • To leave the settlement, submit a written exclusion request online or by first-class mail by December 28, 2026. A mailed request must be received by that date.
  • The request must include your name, address, telephone number, the specified exclusion statement naming this case, and your signature.
  • If you opt out, you will not receive settlement money. If you stay in the settlement, you may object, whether or not you submit a claim.

When could payments be sent?

The hearing is not a payment date. The notice does not give a specific date when payments will be sent.

  • The Court is scheduled to decide whether to approve the settlement on March 2, 2027, at 9:00 a.m. Pacific Time.
  • Even if the Court approves it, appeals may delay payments; the notice says an appeal can take a long time, perhaps more than a year.
  • Payments will be distributed only after approval and after any appeals are resolved.

What non-cash changes does Natera agree to make?

The settlement includes these non-cash changes in addition to the payment fund.

  • Natera agreed to add a billing-policy and payment-options message to patient invoices for these tests.
  • It also agreed to add a price-transparency message to requisition forms. That message says patients must provide insurance information and a phone number or email when the test is ordered; patients receiving text information must also have opted in to text messaging.
  • These are changes to future forms and invoices. The notice does not describe a claim process for receiving them.
