Who Is Included

Who can receive a payment?
The settlement covers three groups: people nationwide who got repeated BuyAlerts marketing texts after using “stop” or a similar opt-out message; Florida residents who got repeated marketing texts at least 15 days after texting “stop”; and people nationwide who got repeated sales texts while their number had been on the National Do Not Call Registry for at least 30 days, subject to the notice’s consent-related condition for that group.

- You may be in more than one class, but you may submit only one Claim Form and receive only one payment.
How much could I receive, and can payments from different classes be added together?
The payment is not guaranteed to be $42.16. The settlement fund also covers notice and administration costs, any attorneys’ fees and expenses the Court awards, and any approved service awards.
- The payment is up to $42.16 per Settlement Class Member.
- It is not a separate $42.16 payment for each class you qualify for.
- The amount may be reduced evenly if the available fund cannot cover $42.16 for every approved claim and the other court-approved settlement costs.
What do I need to do to make a claim, and do I need documents?
A claim is the only way to receive a payment. The notice says the form must be timely, valid, complete, and verified. It does not specify in the notice whether supporting documents are required, so follow the instructions on the Claim Form carefully.
- Complete and sign the Claim Form.
- Submit it online or mail it using the form’s instructions.
- The claim deadline is February 16, 2027. Mailed claims must be postmarked by 11:59 p.m. Eastern that day.
When would payments be sent?
The final approval hearing is scheduled for February 1, 2027, at 9:00 a.m. Eastern by Zoom video conference. That hearing date does not mean payments will be sent then.
- The Court must approve the settlement.
- Any appeals must be final before payments can be made.
- The notice says appeals can take more than a year to resolve, so it does not give a payment date.
What happens if I opt out of the settlement?
Opting out means leaving the settlement. You will not receive a payment, but you will not be bound by the settlement and keep the ability to pursue your own case about the released telemarketing claims. If you stay in the settlement, you cannot bring or remain in another lawsuit against BuyAlerts over the released text-message claims.
- Mail a signed written request for exclusion by January 4, 2027.
- Include your name, address, telephone number, current phone number and any number where you received a BuyAlerts text, and a statement that you want to be excluded.
- You cannot opt out by phone, fax, or email.
Can I object to the settlement instead of opting out?
Objecting asks the Court not to approve some or all of the settlement. It is different from opting out: an objection does not remove you from the settlement.
- You must stay in the Settlement Classes; a person who opts out cannot object.
- File a written objection with the Court and mail a copy to the Administrator by January 4, 2027.
- The objection must identify you, provide information to confirm class membership, explain your objections, and include the other information the notice requires.
