Does getting a notice mean I am definitely part of the Settlement Class?
Not necessarily. The notice says that receiving an email or mailed notice means Equifax’s records identify you as part of the Settlement Class. The legal class definition still depends on whether Equifax reported an affected credit score or attribute to a third party in a Class Transaction.
Equifax, its affiliates, employees, officers, directors, and the judge or judges assigned to the case are excluded.
Why is the payment estimate a range rather than a guaranteed amount?
The payment is not a fixed amount. Valid, timely claimants would divide the money left after Court-approved fees, expenses, notice, and administration costs are paid. The notice estimates about $95 to $280 per claimant, but says the actual amount could be higher or lower depending on the number of valid claims.
Do I need to send documents with my Claim Form?
The notice requires a completed Claim Form submitted online or mailed to the Settlement Administrator by the deadline. It does not say whether the form requires documents to support eligibility or any loss. The notice also does not describe what makes a claim “valid” beyond being completed and timely submitted.
What must I do if I want to opt out?
Opting out means leaving the settlement. You would not receive a settlement payment or be able to object, but you would not be bound by the settlement and would keep the right to bring your own case against Equifax about these issues.
- Mail a signed written request yourself; a third party or company cannot do this for you.
- Include your full name, address, email address, the case name and number, a statement that you want to be excluded, and your signature.

Can I object to the settlement and still ask for a payment?
You may object without giving up the chance to submit a Claim Form. But you cannot object if you opt out.
- File the objection with the Court or have it postmarked by November 27, 2026.
- Include the case name and number, your full name, address, and email address if you have one.
- Explain your reasons and attach any supporting documents.
- Personally sign the objection. If represented, include your lawyer’s contact information.

What happens if I do nothing?
If you do nothing, you will not receive a payment. If the settlement is approved and becomes final and effective, you will still be bound by it and generally cannot start, continue, or join another lawsuit against Equifax about this coding issue.
When would payments be sent, and do I need to attend the final approval hearing?
The Court is scheduled to consider final approval on January 22, 2027, at 2:00 p.m. You do not have to attend. The notice says the hearing could be moved or held remotely without further notice. Payments can be made only after final approval and after the settlement becomes effective; the notice does not give a payment date.
