BMW Sealing Defect Settlement: What X3-X7 Owners Could Recover

This reimbursement is for certain past out-of-pocket repairs, not every vehicle repair. The notice makes reimbursement conditional on the type of repair, where it was performed, the vehicle’s age and mileage, and the required records.

• A Sealing-Defect Repair means a repair of the shark-fin antenna, telematics unit, or battery for the telematics unit.
• For a repair already paid for before the Settlement’s Effective Date, reimbursement is 100% of the cost at a BMW Center, with no cap. An independent-shop repair can be reimbursed at 100%, but no more than $2,000.
• At the time of repair, the vehicle had to be below the 10-year or 120,000-mile limit, measured from its in-service date. Any prior goodwill adjustment, coupon, refund, or payment from the listed BMW-related sources, an insurer, or an extended-service-contract provider reduces the reimbursement.

A Claim Form is required only for reimbursement of past expenses. Keep copies of the records you submit.

• Complete the Claim Form and send it with all required proof to the address on the form, or submit it through the online settlement portal.
• The notice lists the current claim deadline as August 27, 2026. It also says that date may change.
• The records must identify the repair shop, vehicle and owner or lessee, mileage and age at repair, separately listed parts and labor, payment, the repair’s nature and date, and the parts and part numbers.

The notice provides a chance to correct a deficient reimbursement claim, but it does not describe an additional appeal process after a final invalid-claim decision.

• The Claims Administrator will notify you if it finds your claim deficient, such as because documents are missing.
• You then have 30 days to cure, meaning fix, the problem.
• If the Administrator still finds the claim invalid, its decision is final under the process described in the notice.

The extended warranty is available regardless of whether the Court grants final approval. The separate 60-day repair period depends on final approval.

• BMW NA extended coverage for Sealing Defects to 10 years or 120,000 miles from the vehicle’s in-service date, whichever comes first. It covers diagnostics and Sealing-Defect Repairs at a BMW Center.
• For a repair needed after the notice was mailed, take the vehicle to a BMW Center to receive the free repair under this extension. The notice says reimbursement is not available for repairs performed after that mailing date.
• If final approval is granted, BMW Centers also will provide no-cost Sealing-Defect Repairs for 60 days after the Final Approval Order, without an age or mileage limit.

These limits are important if the vehicle has a salvage or flood history, or if a repair was not done by a BMW Center.

• The warranty extension does not apply to a vehicle declared a total loss, sold for salvage, or branded with a salvage or flood title.
• BMW NA does not guarantee do-it-yourself repairs or repairs by independent shops. If one of those repairs fails after a member makes a reimbursement claim, that member cannot submit another claim or seek replacement through the extended warranty.
• The notice also says replacement parts not certified by the original equipment manufacturer are not warranted, and that other limits may be in BMW NA’s New Passenger Vehicle Limited Warranty and the Settlement Agreement.

Submitting a claim does not mean payment is immediate. Payment timing depends on the settlement becoming effective and the claim being processed.

• Claims are processed and payments are issued on a continuing, rolling basis after the Effective Date.
• The Effective Date comes after the Final Approval Hearing and after any appeals are resolved.
• The notice does not give a specific date when an individual reimbursement payment will arrive.

The release does not include personal-injury claims or damage to property other than the Class Vehicle, according to the notice’s summary of released claims.

• If you do nothing, you remain in the settlement and give up the right to bring or join another lawsuit against BMW NA over the claims released by the settlement.
• You will not receive reimbursement for past expenses unless you file a Claim Form with the required supporting documents by the deadline.
• The extended warranty can still apply to your Class Vehicle.

Excluding yourself, often called opting out, means leaving this settlement. It is different from objecting, which is for someone who stays in the settlement but disagrees with it.

• To exclude yourself, mail a signed letter by June 30, 2026. Include your name and current address; each Class Vehicle’s model year, model, VIN, and purchase or lease date; and a clear statement that you want to be excluded from the settlement and class.
• You cannot exclude yourself by phone or online.
• A person who excludes themselves cannot receive reimbursement benefits or object, but the vehicle still receives the limited warranty extension described in the notice. Excluding yourself preserves the ability to sue or continue another case over the claims at issue.

An objection tells the Court why you disagree with the settlement while remaining covered by it. The hearing date may change.

• You may object only if you remain in the settlement. Your written objection must be mailed to the Court, Claims Administrator, Class Counsel, and BMW NA’s counsel by June 30, 2026.
• The notice requires detailed identifying information, the grounds and supporting documents for the objection, proof that you owned or leased a Class Vehicle, a statement that you have not opted out, and other listed information.
• The Final Approval Hearing is scheduled for July 28, 2026, at 10:00 a.m. in Newark, New Jersey. To ask to speak there, send a Notice of Intent to Appear by June 30, 2026, using the requirements and addresses for objections.
