Questions & Answers

Can I request both types of cash payment?

Can I claim both documented losses and lost time?

  • You can seek both Cash Payment A for documented losses and Cash Payment B for lost time on one claim form.
  • The two cash benefits share a $3.4 million cap. If valid cash claims total more than that amount, each cash payment will be reduced proportionally.

Which losses may qualify for the documented-loss payment?

Cash Payment A may reimburse up to $5,000 in qualifying out-of-pocket losses. It is not a payment for every expense someone may connect to the incident.

  • Eligible unreimbursed losses can include fraud-related bank fees, credit-monitoring or identity-protection costs bought in response to the incident, credit-freeze costs, professional help with identity fraud, replacement identification, and certain phone, postage, notary, or similar costs.
  • The loss must be more likely than not caused by the Data Incident and incurred from October 1, 2024 through the date of the notice.
  • You cannot recover an expense that another source has already reimbursed, including compensation connected to identity-protection and credit-monitoring services offered with the Defendants’ notification letter.

What proof is needed for a documented-loss claim?

What records do I need for a documented-loss claim?

  • Submit reasonable documentation from a third party with the claim, such as telephone records, correspondence, or receipts.
  • Your own certification, declaration, or affidavit does not count as documentation by itself. It can only add explanation or context to other supporting records.
  • If you do not provide reasonable documentation, or do not fix a rejected claim after being given a reasonable opportunity, the documented-loss claim will be rejected.

How does the lost-time payment work?

What does the lost-time payment cover?

  • Cash Payment B is limited to four hours at $18 per hour, or up to $72.
  • You must use the claim form, select this benefit, and certify that you spent time responding to the incident.
  • The notice says lost time includes time dealing with anxiety, stress, and loss of sleep. The time must fall between October 1, 2024 and the date of the notice.

How do I activate the two years of credit monitoring?

How do I get the credit-monitoring benefit?

  • You do not need to file a claim form for this benefit if you remain in the Settlement Class.
  • After final approval and the settlement becomes effective, use the unique code sent by email or on a postcard to activate two years of Cyex Financial Shield Complete.
  • If you do not know the code, the notice says you can contact the Settlement Administrator.

What is the deadline and method for submitting a claim?

How and when do I submit a cash-payment claim?

  • Submit one claim form online by 11:59 p.m. Central Time on October 19, 2026, or mail it so it is postmarked by that date.
  • Select the cash benefit or benefits you want. Include third-party reasonable documentation if requesting documented losses.

When will cash payments and credit monitoring be available?

When could benefits become available?

  • Cash payments and credit-monitoring enrollment will begin only if the Court grants final approval and any appeals are resolved.
  • The Final Approval Hearing is scheduled for December 14, 2026, at 2:00 p.m. Central Time. Appeals, if any, can delay benefits.

What must I do to opt out of the settlement?

How do I opt out, and what does it change?

  • To leave the settlement, mail a written Request for Exclusion to the Settlement Administrator, postmarked by November 16, 2026.
  • The request must provide your name, address, telephone number, email address if any, a statement that you want to be excluded from this settlement, and your personal signature.
  • A person who opts out receives no settlement benefits but keeps the right to separately sue the Defendants about the legal issues in this case.

What happens if I take no action?

What happens if I do nothing?

  • If you stay in the Settlement Class and do not submit a cash claim, you will not receive a cash payment.
  • You will still be able to activate the credit-monitoring benefit using your unique code.
  • You will be bound by the settlement’s release, which means giving up the right to start, continue, or join another lawsuit about the legal issues resolved by this settlement.
