Questions & Answers

What are the payment options, and can I use both?

The payment level depends on whether you submit qualifying proof of purchase. A household cannot make one claim in each category.

  • You can claim $1 per unit without receipts, up to $10 per household.
  • You can claim $1 per unit with qualifying proof of purchase, up to $150 per household.
  • You may submit only one claim, so these are alternatives rather than benefits that can be added together.

What can I use as proof of purchase?

If the Claims Administrator rejects your proof, the notice says your request will instead be handled as a claim without proof of purchase. That means the lower $10 household maximum applies.

  • A receipt or purchase record from a Released Party.
  • A removed UPC code.
  • Other third-party commercial documentation that reasonably shows the purchase and its date in the United States during the class period.

What do I need to do to make a claim?

A claim form is required whether or not you have proof of purchase. The notice provides the mailing address for the Claims Administrator but does not describe the form's other fields or instructions.

  • Submit a Claim Form online or by mail.
  • Sign the form under penalty of perjury.
  • Submit it online or postmark it by 11:59 p.m. Pacific Time on February 20, 2026.

Could my payment be less than the stated amount?

The listed per-unit amounts and household caps are not guaranteed payment amounts if the money available for class payments is insufficient.

  • The total fund is $3 million, but it also pays approved attorneys' fees and costs, administration and notice costs, and any service award.
  • If approved claims are more than the money left for class payments, payments will be reduced proportionately.
  • The notice says this adjustment will be made before a single distribution.

When would payments be sent, and what if I do not redeem one?

If you receive a payment and do not redeem it within 180 calendar days after it is issued, it becomes an unredeemed payment. The Claims Administrator will have no further obligation to pay it, and the money, including accrued interest, will be donated to the Clean Label Project.

  • Payment depends on final court approval.
  • If an appeal is filed, payment also waits until any appeals are resolved in favor of the settlement.
  • The notice does not give a specific date when payments will be issued.

How do I opt out, and what changes if I do?

Leaving the settlement means you cannot receive a settlement payment or object to the settlement. It preserves your ability to sue ZOA Energy or the Released Parties later about the claims resolved here.

  • Send an individual written exclusion request to the Claims Administrator.
  • Include your name and address, the words “I wish to be excluded from the ZOA Energy Drink Class Action,” and your signature.
  • A mailed request must be postmarked by February 13, 2026; a personally delivered request must be received by then, in each case by 11:59 p.m. Pacific Time.

How can I object to the settlement?

You may object only if you remain in the class. You may still file a claim if you object.

  • An objection must be in writing.
  • It must identify the case, give the objector's contact information, and explain the objection and its grounds.
  • File it electronically or in person with the Northern District of California, or mail it to the Class Action Clerk at the listed San Francisco address.
  • It must be filed or postmarked by February 13, 2026.

What happens if I do nothing?

The notice refers to the full definition of the released claims in Section 1.30 of the Settlement Agreement; it does not provide that complete definition in the notice itself.

  • You will not receive money from the settlement.
  • If the settlement receives final approval, you give up the right to sue ZOA Energy and the Released Parties over the released claims.
  • You are bound by the settlement even if you do not file a claim, unless you properly opt out.

Do I need to attend the Final Approval Hearing, and can I speak?

The notice contains conflicting courtroom information, so it does not reliably identify a single courtroom for the hearing.

  • The hearing is scheduled for March 26, 2026, at 10:00 a.m. Pacific Time.
  • You do not have to attend.
  • To speak at the hearing, you must first properly file an objection and ask the Court for permission.
  • The hearing date, time, or location may be changed without additional notice.

Does the notice say whether ZOA must change its labeling or practices?

Injunctive relief generally means a commitment to do or stop doing something, but this notice does not specify what ZOA agreed to do.

  • The notice says the settlement provides injunctive relief as well as money.
  • It does not describe the specific injunctive relief in the notice.
  • It states that full details are in the Settlement Agreement.
