USA Clinics Group TCPA Settlement: What Claimants Got

What text messages count for this settlement?

• The notice covers people in the United States who received more than one qualifying USA Clinics Group marketing text within a 12-month period during the class period. The texts must have been sent either after the person replied with a stop or similar opt-out instruction, or while the number had been on the National Do Not Call Registry for at least 30 days without the person’s prior permission.
• A postcard or email notice means company records indicate that USA Clinics Group texted the number, but it does not itself guarantee class membership.

How are messages counted if I used more than one phone number?

• You may submit only one claim. Use it to include messages sent to all of your telephone numbers, but payment is limited to no more than three messages per person.
• The Settlement Administrator, using USA Clinics Group’s records, decides how many messages are counted. The notice does not say that you choose or prove the number yourself.

How do I submit a claim, and what do I need?

• You need a LoginID. It is on the postcard notice, or you can obtain it by contacting the Settlement Administrator.
• You may file online or send a paper form by mail. A mailed form must be postmarked by the deadline. The notice sets the deadline at 11:59 p.m. Eastern on October 5, 2026.
• The notice says to read the claim-form instructions, complete and sign the form, and submit it on time.

Do I need to send supporting documents with my claim?

• The notice does not list a standard set of documents that every claimant must submit. It does require a complete, valid, verified claim with a LoginID.
• The administrator reviews claims and can ask for more information. If requested information is not provided on time, the claim will be denied and will not be paid.

Is the $50 per text payment guaranteed?

• The stated amount is up to $50 for each counted text, with a maximum of three texts per person. It is not a guaranteed $50 per text.
• The $574,350 fund also pays administration and notice costs, court-approved lawyers’ fees and expenses, and any approved award to the class representative. If the remaining available money cannot cover all approved claims at $50 per message, each per-message payment will be reduced proportionally.
• Any money left after distributions returns to USA Clinics Group.

When would payments be sent?

• No payment date is promised. The Court is scheduled to consider approval on September 18, 2026.
• Payments can be made only if the Court approves the settlement and any appeals have ended. The notice says appeals can take more than a year.

What must I do if I want to opt out?

• Leaving the settlement is called excluding yourself, or opting out. It means you cannot receive a settlement payment, but you keep the right to pursue your own case about the released telemarketing claims.
• To opt out, mail a signed exclusion letter by August 19, 2026. The letter must give the case name, your contact details, your current number and any number that received a USA Clinics Group text, a statement that you want to be excluded, and your signature.
• You cannot opt out by phone, fax, or email. You also cannot object if you opt out.

Can I object and still receive a payment?

• You may object only if you are a class member and do not opt out. An objection does not prevent you from receiving a payment if the settlement becomes final.
• Your written objection has detailed content requirements, including your identifying and class-member information, specific reasons and basis for the objection, witness and attorney information if applicable, and whether you plan to attend the hearing.
• You must file the complete objection with the Court and send a copy to the Settlement Administrator by August 19, 2026.

Do I have to attend the hearing, and can I speak?

• The hearing is scheduled for 12:00 p.m. EST on September 18, 2026, by Zoom. The Court may change the date or time.
• You do not have to attend for the Court to consider a timely, valid written objection. If you want to speak at the hearing, you must not have opted out and must say in your objection that you intend to appear.

What happens if I do nothing?

• If you neither submit a claim nor opt out, you receive no money.
• If the settlement becomes final and you did not opt out, you give up the ability to bring, continue, or join claims against USA Clinics Group concerning the released text-message issues during the class period. The notice describes these as including TCPA and other federal or state telemarketing claims related to those messages.
