University of Hawai‘i Data Incident Settlement

• You must be a living person in the United States who received notice that your Private Information may have been compromised in this incident.
• The notice excludes the presiding judge and certain immediate family members when there is a conflict, the University and listed related entities and officials in specified circumstances, and people who make a valid, timely exclusion request.

• You can choose either reimbursement for documented losses of up to $5,000 or the alternate cash payment estimated at $50. You cannot receive both cash options.
• You may also claim one year of CyEx Medical Shield Pro Medical Data Monitoring in addition to the cash option you choose.
• The alternate cash amount is an estimate. It may go up or down depending on the money available after the settlement’s other required payments and the value of valid claims.

• For the up-to-$5,000 option, submit reasonable records showing fraud or identity-theft losses that can reasonably be traced to the incident. Examples include phone records, correspondence or emails, and receipts.
• A personal statement, certification, declaration, or affidavit by itself does not count as documentation, though it may help explain other records.
• The alternate cash option does not require loss documents. If a documented-loss claim lacks reasonable support or is invalid and not corrected, the notice says it will be processed as an alternate-cash claim.
• Do not claim an expense already repaid by another source, including the credit-monitoring and identity-theft protection product mentioned in the notice.

• Submit a complete Claim Form online by November 2, 2026, or mail it so it is postmarked by that date.
• You can obtain a form from the settlement website, request a mailed copy by phone, or write to the Settlement Administrator at P.O. Box 3719, Portland, OR 97208-3719.
• The notice cautions that ordinary mailing may not receive a same-day postmark. It suggests mailing at least a week early, requesting a manual postmark, or using Certified Mail.

• The settlement fund is $3.5 million, not a separate guaranteed payment for each person.
• It must cover valid benefit claims, settlement administration, and any attorneys’ fees, costs, and service awards the Court approves. That is why the alternate cash payment can change.
• Benefits are due only after the Court approves the settlement and it becomes final. The notice does not give a specific payment date.

• Doing nothing means you receive no settlement benefits.
• If the settlement receives final approval, you will be unable to bring, continue, or join another lawsuit against the University or other released parties based on claims related to this data incident.

• You may object only if you remain in the settlement class; you cannot both object and exclude yourself.
• A written objection must be mailed to the Court Clerk, Class Counsel, the University’s counsel, and the Settlement Administrator, and be postmarked by October 19, 2026.
• The notice lists detailed required information, including your contact information, the case information, your reasons, and your personal signature.

• The hearing is scheduled for November 4, 2026, at 9:00 a.m. at Kaʻahumanu Hale, 777 Punchbowl Street, Honolulu, Hawaiʻi.
• You do not have to attend. The notice says the date, time, format, or location may change, and the hearing could be held by videoconference or telephone.

The official notice contains wording that does not line up cleanly in every place. We have not guessed at a resolution; check the notice and confirm important details before acting.

• The notice contradicts itself about opting out: one section says an opt-out preserves the right to sue, while another says an opt-out gives up that right and remains bound. Confirm this directly with the settlement administrator or counsel before acting.
