Twin Cities Pain Clinic Data Incident Settlement

The notice defines the group by whether Private Information was accessed and/or acquired because of the incident. It does not say that fraud or misuse must have occurred for someone to be in the class.

• The class includes people in the United States whose Private Information was accessed and/or acquired in the Data Incident.
• The notice excludes TCPC and its officers, directors, and related companies; government entities; the judge, the judge’s family and staff; and people who validly opt out.

A class member may claim credit monitoring along with one cash option. The two cash options cannot be combined: Flat Cash is offered instead of payment for documented losses.

• Two years of CyEx Financial Shield Complete credit monitoring.
• One cash option: either documented-loss reimbursement or Flat Cash.

This option is for actual, documented losses due to the Data Incident. Examples include certain credit-related fees, costs to replace identification, and postage for contacting banks by mail. The notice gives examples rather than an exhaustive list.

• Extraordinary losses caused by identity theft or fraud may be reimbursed up to $4,500.
• Ordinary out-of-pocket expenses may be reimbursed up to $450.
• The loss must have occurred between July 9, 2025, and November 9, 2026.
• A loss already reimbursed by someone else cannot be claimed.

Documents are required for the documented-loss option. They are not required for the Flat Cash option, which is expected to be $55.

• Send records such as bank statements or receipts that show how much was spent or lost.
• The materials should show that the expense was caused by the Data Incident.
• Personal notes or papers may help explain other proof, but cannot be the only support for the claim.

The $55 amount is not guaranteed. It may be reduced if the total Cash Payment claims are more than the settlement’s cash-payment cap.

• The Flat Cash payment is expected to be $55.
• All Cash Payment benefits together are capped at $385,000.
• If claims exceed that cap, Cash Payment amounts will be reduced proportionately.

The notice says a valid and timely Claim Form is the only way to receive benefits or payment. A mailed claim must include supporting documentation where required.

• File online by November 9, 2026.
• Or mail a completed and signed Claim Form to the Settlement Administrator, postmarked by November 9, 2026.
• A Claim Form can be submitted online, downloaded for mailing, or requested from the Settlement Administrator by phone, email, or mail.

Opting out, also called excluding yourself, is different from objecting. An objection asks the Court not to approve some or all of the settlement; it does not remove you from it.

• If you do nothing, you receive no settlement benefit or payment.
• Unless you opt out, you remain in the class and give up the rights described in the Settlement Agreement’s releases.
• To keep any rights you may have to sue TCPC on your own over the issues in this case, you must formally opt out by November 9, 2026. Opting out means you cannot receive settlement benefits.

Benefits are not issued simply because the hearing date has passed. The notice says payments will be distributed only if the Court grants final approval and after any appeals are resolved.

• The hearing is scheduled for January 20, 2027, at 1:30 p.m. Central Time, by Zoom.
• The Court will decide whether to approve the settlement and will consider objections.
• You do not have to attend. The notice says the hearing date or time may change.
