Who Is Included
Living U.S. residents who received notice that their Private Information may have been accessed in the Data Incident, subject to the listed exclusions.
- Proof required: Documented-loss claims require proof such as bank statements or receipts; self-prepared notes alone are insufficient, and the materials should show the expense was caused by the Data Incident. The pro rata cash payment requires no documentation or explanation, but a valid Claim Form is required.

- Claim deadline: 2026-12-07

Questions & Answers
What does the medical monitoring include, and what if I lost my enrollment code?
All Settlement Class Members can enroll in one year of CyEx Medical Shield Complete medical-data monitoring.
- It monitors exposure of healthcare insurance identification numbers and medical record numbers, as well as unauthorized health savings account spending.
- It includes $1 million in medical identity-theft insurance and access to a fraud-resolution agent if suspicious activity occurs.
- The notice says enrollment codes were sent by postcard and/or email. If a code is missing, contact the Settlement Administrator. The notice does not clearly explain the enrollment steps or whether a Claim Form is needed for this benefit.
What losses can I seek reimbursement for?
You may seek reimbursement for actual out-of-pocket losses caused by the data incident, up to $3,000. This is not a flat payment: it is for qualifying losses you actually had.
- Losses must have been incurred from April 29, 2025, through December 7, 2026.
- Examples include identity-theft or fraud losses, certain credit-reporting or credit-freeze fees, replacement costs for government identification, and postage used to contact banks.
- Costs already reimbursed by someone else cannot be claimed.
What proof do I need for a documented-loss payment?
A documented-loss claim needs supporting records. A signed form, statement, or personal notes alone do not meet the notice's proof requirement.
- Send proof of the amount spent or lost, such as bank statements or receipts.
- The materials should show that the expense resulted from the data incident.
- Personal notes may help explain other evidence, but notes or papers created by you cannot be the only proof.
What is the pro rata cash payment, and do I need documents for it?
The pro rata cash payment is a one-time share of remaining settlement money. It is not a promised dollar amount.
- This payment is separate from, and may be claimed in addition to, a documented-loss payment.
- No documents or explanation are required for this payment, but you must make a valid claim for it.
- Its amount is not set. It depends on what remains in the fund after expenses and other benefits are paid, and that remainder is split equally among valid claimants for this payment.
Could my documented-loss payment be reduced?
The $3,000 figure is a per-person maximum, not a guarantee. Documented-loss payments can be reduced if the total of valid claims exceeds that benefit's cap.
- All valid documented-loss claims together are limited to $1,500,000.
- If valid claims total more than that, each payment will be reduced proportionally.
- The overall $2,340,000 settlement fund also pays administration costs, court-approved attorneys' fees and costs, and any approved service awards before class benefits are paid.
How do I submit a cash claim, and when is it due?
To seek either cash payment, submit a Claim Form by the deadline. Include supporting records if you are claiming documented losses.
- You can submit online by December 7, 2026.
- For a mailed claim, the completed and signed form, plus supporting documents when required, must be postmarked by December 7, 2026.
- The notice says to submit online or download a form to mail; it also says you can ask the Settlement Administrator for a paper form.
When will payments be sent?
The notice does not give a payment date. The December 22, 2026 hearing is when the court will consider approval, not a date when payments are promised.
- The court must first grant final approval.
- Appeals may be filed, and the notice does not say how long they could take.
- Payments are to be distributed only after final approval and after any appeals are resolved.
What is the difference between opting out and objecting?
Do not confuse opting out with objecting. They have different results.
- Opting out means leaving the settlement. You will not receive settlement benefits, but you keep any rights you may have to bring your own case about the issues involved.
- Objecting means telling the court why you oppose the settlement. You can object only if you remain in the settlement class, and you may still file a claim.
- Both actions have a December 7, 2026 deadline. An objection has detailed filing and mailing requirements in the notice.
