Questions & Answers
Who is included in these settlements?
The settlement covers people who meet the nationwide Class definition. The notice also excludes, among others, defendants and certain related people or entities, lawyers in the case, people who previously opted out, and people whose claims were already finally decided or released.
- You must have used the Flo App in the United States during the class period and entered menstruation and/or pregnancy information in the app during that time.
- You cannot have previously excluded yourself from the class, and you cannot fall within one of the notice’s listed exclusions.
- The California Subclass has additional California-use and residence requirements.
What is different for California Subclass members?
California Subclass members have the same basic claim process but are assigned twice the pro rata amount assigned to authorized claimants who are not in that subclass.
- You must have used the Flo App in California during the class period, entered menstruation and/or pregnancy information, and lived in California then.
- California did not have to be your legal residence.
- To receive the higher allocation, you must provide reasonable documentation showing California Subclass membership.
How do I submit a claim, and what happens if there is a problem with it?
If the administrator finds a non-fraud-related problem with a claim, it will contact the claimant. The claimant then has 20 days from the written notice to fix the problem. A claim found to be fraudulent is denied without that opportunity.
- Submit the Claim Form online by 11:59 p.m. Pacific Time on October 15, 2026, or mail it with an October 15, 2026 postmark.
- The administrator will review the form to see whether enough information was provided to validate class membership.
- The notice does not specify the precise information or documents required for a standard claim. It does say that California Subclass members need reasonable documentation for the higher payment level.
How is the settlement money divided, and can I know my payment amount now?
No individual payment amount is known now. It will depend in part on the number of valid claims, Court-approved deductions, California Subclass status, and the allocation plan.
- The three settlements total $59.5 million.
- Costs approved by the Court—including notice and administration costs, taxes, service awards, attorneys’ fees, and litigation expenses—come out of that fund first.
- The remaining Net Settlement Fund is divided proportionally among authorized claimants under a plan approved by the Court.
What happens if my calculated payment is very small or money is left over?
- A payment is issued only if the calculated pro rata amount is at least $1.00.
- If money remains after claims are paid, it may be redistributed to authorized claimants when practical and economical.
- Any amount that still cannot feasibly be distributed will go to a Court-approved non-profit, non-sectarian organization. It will not return to Google, Flo, or Flurry.
When might payments be sent?
The hearing date is not a payment date, and the notice does not give a definite payment date.
- The Court is scheduled to consider approval on October 29, 2026, at 11:00 a.m. Pacific Time.
- Payments can be made only after the Court gives final approval, claims are processed, and the settlements reach their Effective Dates.
- Appeals may delay payment. The notice says the appellate and claims process can sometimes take a year or more.
Does this settlement affect the separate Meta verdict?
- This notice covers settlements with Google, Flo, and Flurry, not Meta.
- The Meta trial ended with a jury verdict for the plaintiffs.
- The notice says people eligible for money from the Meta verdict will be contacted later, and choosing an option under this notice does not affect that right.
Can I object to the settlements and still make a claim?
The notice requires specific identifying information, an explanation of the legal and factual basis for the objection, and other listed materials. It also explains how to request permission to speak at the hearing.
- You may object if you are a Class Member and did not previously exclude yourself.
- An objection must be written and filed with the Court by October 8, 2026. Telephone and email objections are not accepted.
- You may still submit a claim even if you object.
