MUBI Automatic Renewal Settlement: Who Qualified in California

The settlement class is based on these stated conditions. The notice does not say that every person who receives notice is automatically entitled to payment.

• You must have lived in California when you signed up for MUBI.
• You must have signed up on or after April 1, 2021, and the subscription must have renewed between April 1, 2021 and May 31, 2025.
• You cannot have received a refund from MUBI of all renewal subscription charges.
• Certain people and entities are excluded, including timely opt-outs, government entities, MUBI and specified related people or businesses, the parties’ counsel and firms, and the presiding judge or judicial officer, their immediate families, and judicial staff.

Because both the deductions and the number of valid claims are unknown, the notice does not provide an estimated individual payment amount.

• The payment is not a fixed amount.
• Valid claimants will split what remains of the $1.6 million fund equally after notice and administration expenses, Court-approved attorneys’ fees and costs, and any Court-approved award to the class representative are deducted.
• The attorneys may request up to 25% of the fund ($400,000) in fees, plus reasonable costs. The Court may award less. The class representative’s requested award can be up to $5,000.

You may choose an electronic payment or a mailed check if your valid claim is approved. The notice does not detail the electronic-payment options.

• Complete, sign, and submit a Claim Form by June 9, 2026.
• You may submit it online or mail it to Kroll Settlement Administration. A mailed form must be postmarked by June 9, 2026.
• You must attest under penalty of perjury that you are a class member and that the information you provide is true and correct to the best of your knowledge, information, and belief.
• The notice does not describe a requirement to provide receipts, subscription records, or other loss documents. It does say the form must contain all requested information.

A claim form is not a substitute for an exclusion request. The notice says a person seeking payment must not opt out.

• To leave the settlement, mail an exclusion request to the settlement administrator by June 9, 2026.
• The request must give your name, address, and telephone number; be personally signed by you; and include the required request-to-be-excluded statement identifying this case.
• If you opt out correctly, you will not receive settlement compensation and cannot object. Leaving the settlement is the option that preserves your ability to sue MUBI yourself about the claims in this case.

Objecting means asking the Court not to approve the proposed settlement. It is different from opting out: a person who opts out cannot object.

• An objection must be in writing and must identify the case, give your contact information, state all grounds for the objection, and include supporting materials if any.
• It must also include the listed witnesses, if any; whether you plan to attend the hearing; proof of class membership or a signed penalty-of-perjury statement; a list of certain class-settlement objections made by you and your lawyer during the past three years; and signatures.
• You may file electronically or in person with the Northern District of California, or mail it to the Class Action Clerk in San Jose by June 9, 2026.
• Objecting does not itself provide a payment. A class member who objects must still submit a timely valid claim to receive a cash award.

The hearing is not a payment date. Cash awards can be distributed only after final approval and after any appeals are resolved in favor of the settlement.

• The Court is scheduled to consider approval on July 16, 2026, in Courtroom 1 on the fifth floor of the San Jose Division of the federal court at 280 South 1st Street, San Jose, California.
• You do not have to attend. Class Counsel will appear for the settlement class.
• To ask to speak, you or your lawyer must state in your timely objection that you intend to appear. People who opted out cannot speak at the hearing.
• The hearing date may change without another notice to the class.

The released claims concern allegations about MUBI’s automatic renewal of subscriptions during the class period in this case.

• You remain in the settlement class.
• You give up the right to sue MUBI over the claims released by this settlement.
• You will not receive a cash award because a valid claim form is required.
