Questions & Answers

Who is included in the settlement?

The settlement covers people in California or Pennsylvania who used Labcorp’s website search features between May 1, 2021, and April 1, 2026. The notice gives a broad definition of a search query.

  • California Settlement Class: people in California who conducted qualifying Search Queries on Labcorp’s website during the stated period.
  • Pennsylvania Settlement Class: people in Pennsylvania who did the same.
  • A Search Query includes typing a term into a search bar or menu, or selecting an option from a drop-down menu on Labcorp’s website or its subpages.
  • The notice excludes Labcorp and its current employees, officers, directors, related entities, certain representatives and successors; plaintiffs’ lawyers and their employees; and the assigned judge and court staff.

Will class members receive money, and what monetary rights do they keep?

No. This settlement provides business-practice changes rather than cash payments to class members. Class members, other than the class representatives, also keep their claims for damages or other monetary relief.

What would Labcorp have to do under the settlement?

If the settlement receives final approval and any appeals are resolved, Labcorp has agreed to make these website tracking-practice changes. The notice describes them as injunctive relief, meaning requirements to change business practices rather than payments to individuals.

  • Labcorp would stop using or enabling certain tracking technologies on labcorp.com and its subpages for two years. The settlement agreement defines the technologies; the notice gives Meta Pixel and Google Analytics as examples.
  • Labcorp would conduct an annual compliance review and prepare a report.
  • Labcorp would create or keep a written policy about using externally developed tracking technologies.
  • Labcorp would appoint a senior employee to oversee compliance.

Do I need to file a claim or provide proof?

No claim form, payment request, or supporting documents are required. You do not need to take action to receive the settlement’s business-practice benefit. If the court approves the settlement, class members are bound by it.

Can I opt out of the settlement?

No. You cannot opt out, also called excluding yourself or leaving the settlement. The notice says this is because the case and settlement seek only injunctive relief, not money damages.

How do I object to the settlement?

A class member may ask the court to deny approval and explain why. The court can approve or reject the proposed settlement; it cannot order a different settlement through this objection process.

  • Mail a written objection to the Clerk, U.S. District Court for the Middle District of North Carolina, 324 W. Market Street, Greensboro, NC 27401.
  • It must be postmarked by November 23, 2026.
  • Include the case name and number; your contact information and signature; the part of the settlement or fee request you oppose and any support or evidence; and a statement explaining your class membership, including your search query and state at the relevant time.

When is the final approval hearing, and can I speak there?

At the final approval hearing, the court will decide whether the settlement is fair, reasonable, and adequate. The hearing could be moved or held by video conference.

  • The hearing is scheduled for December 14, 2026, at 10:00 A.M. Eastern Time.
  • It is scheduled for Courtroom 1 of the U.S. District Court for the Middle District of North Carolina, 324 W. Market Street, Greensboro, NC 27401.
  • You do not need to attend.
  • To ask to speak, mail a Notice of Intention to Appear to the court by November 23, 2026. It may be included with a written objection.

What payments are the lawyers and class representatives seeking?

Class counsel plan to request up to $4.875 million in attorneys’ fees and litigation-expense reimbursement. They also plan to request service awards of up to $2,500 for each of the three class representatives. These are requests, not guaranteed awards; the court may award less. A class member who wants to comment on or object to these requests must follow the written-objection procedure and deadline.
