Highlands Oncology Group Data Breach Settlement: What You Can Claim

The notice defines the group covered by the proposed settlement. It does not say that every type of information listed in the notice was necessarily involved for every person.

• You must live in the United States and have had your Private Information compromised in the June 2025 Data Breach.
• Directors and officers of Highlands Oncology, government entities, the assigned judge and the judge’s immediate family, and Court staff are excluded.

Eligible class members may choose medical data monitoring along with one cash-payment option. A Claim Form is required to receive settlement benefits.

• Three years of CyEx Medical Shield Complete, which includes monitoring for healthcare insurance ID exposure, medical record number exposure, and unauthorized Health Savings Account spending.
• The service includes $1 million in medical identity theft insurance and access to a fraud-resolution agent if suspicious activity occurs.

This is one of the two cash options. It is not a guaranteed $4,250 payment; the amount depends on documented eligible losses, up to that limit.

• You may seek up to $4,250 for actual, documented out-of-pocket losses from fraud or identity theft caused by the Data Incident.
• The loss must have occurred between June 2, 2025, and October 22, 2026.
• The notice gives examples including identity-theft or fraud losses, certain credit-related fees, ID replacement costs, and postage used to contact banks.
• You cannot claim expenses that another party already reimbursed.

These documentation rules apply if you choose the documented-loss payment.

• Send proof of the amount spent or lost, such as bank statements or receipts.
• The proof or supporting explanation should show that the expense resulted from the Data Incident.
• Notes or papers you created yourself may help explain other evidence, but cannot by themselves support a valid claim.

You cannot receive both cash options. The $50 option is the alternative to seeking documented losses.

• You can choose a one-time $50 payment instead of the documented-loss payment.
• No proof or explanation is required for the $50 payment.
• You may also claim the medical data monitoring.

The notice says a valid, timely Claim Form is required for any settlement benefit. It does not provide the full contents of the Claim Form in the notice itself.

• Submit a Claim Form online by October 22, 2026.
• Or download a form, complete and sign it, and mail it to the Settlement Administrator. A mailed claim must be postmarked by October 22, 2026.
• Include supporting documentation when it is required for the benefit you selected.

A hearing date is not a promise that the settlement will be approved or that payments will be sent on that date.

• The Court is scheduled to hold the final approval hearing on November 6, 2026, at 9:00 a.m. Central Time.
• Benefits will be distributed only if the Court approves the settlement and after any appeals are resolved.
• The notice does not give a payment date because appeals may be filed and their timing is unknown.

You may exclude only yourself, not another person. The notice says that a person who opts out cannot object to the settlement.

• To leave the settlement, mail a signed Request for Exclusion that includes the case name, your contact information, and a clear statement that you do not want to participate.
• It must be postmarked by October 7, 2026.
• If you opt out, you receive no settlement benefits, but keep any rights you may have to sue Highlands Oncology yourself about the legal issues in this case.

Submitting a claim is required for benefits. Opting out is the option for someone who does not want to be bound by the settlement.

• If you remain in the class and do nothing, you will not receive a benefit.
• You will give up the rights described in the settlement’s release, including the ability to be part of another lawsuit against Highlands Oncology about issues covered by the settlement.
