Questions & Answers

Who is included in this settlement?

You may be included if you are a living person living in the United States and Finastra sent you notice that your private information may have been affected by the October 2024 incident. The class excludes certain Finastra-related people, government entities, the assigned judge and related court staff, and people who properly opt out.

What benefits can I claim, and which ones can I combine?

Credit monitoring is available to all class members who make a claim. The two cash options are alternatives: choosing the pro rata payment means you cannot also claim documented-loss reimbursement.

  • One year of CyEx Financial Shield Complete credit monitoring, which includes $1 million in financial fraud insurance and help from a fraud-resolution agent if suspicious activity occurs.
  • Either up to $2,500 for qualifying documented out-of-pocket losses or a one-time pro rata cash payment. A pro rata payment is an equal share of the money left after settlement expenses and other benefits are paid.

What losses may qualify for reimbursement?

You may seek up to $2,500 for actual out-of-pocket losses caused by the data incident, incurred from October 31, 2024, through November 27, 2026. You cannot recover expenses that someone else already reimbursed.

  • Losses from identity theft or fraud.
  • Fees for credit reports, credit monitoring, or freezing or unfreezing credit.
  • Costs to replace identification and postage for contacting banks by mail.

Do I need documents to make a claim?

The pro rata cash payment does not require proof or an explanation. It is not a fixed amount; it depends on the money remaining and the number of people who claim it.

  • For documented losses, send records such as bank statements or receipts showing what you spent or lost.
  • The records or accompanying explanation should connect the expense to the data incident.
  • Notes or papers you created yourself may support other records, but cannot be the only proof.

How and when do I submit a claim?

You can submit online or download a form and mail it to the Settlement Administrator. You may also request a paper form by phone, email, or mail.

  • Submit online by November 27, 2026.
  • Or mail a completed and signed Claim Form, with supporting documents when required, postmarked by November 27, 2026.

What happens if I opt out?

Opting out means leaving the settlement. Your request must be submitted, postmarked, or emailed by November 13, 2026. You may opt out only for yourself.

  • You will not receive settlement benefits or payment.
  • You keep any rights you may have to bring your own case against Finastra about the legal issues involved.
  • A valid exclusion request must include the case name, your contact information, your personal signature, and a clear statement that you want to be excluded.

Can I object to the settlement and still make a claim?

An objection tells the Court why you think it should not approve some or all of the settlement. The notice lists detailed information that a valid objection must include.

  • You may object only if you stay in the settlement; someone who opts out cannot object.
  • A timely objection does not prevent you from filing a claim for settlement benefits.
  • The notice requires filing the complete objection with the Clerk of Court and sending copies to the Settlement Administrator, Class Counsel, and Finastra’s lawyers by November 13, 2026.

When will benefits be issued?

The Court has not yet approved the settlement. The final approval hearing is scheduled for December 14, 2026, at 10:00 A.M. Eastern Time by Zoom. If the Court approves the settlement, payments will be distributed only after any appeals are resolved, so the notice does not give a payment date.
