Who is included in the settlement?
The settlement class covers living people in the United States who received notice that their personally identifiable information may have been involved in the Docketwise data incident. Receiving notice is part of the definition; it is not limited simply to anyone who used Docketwise.
Some people are excluded, including certain court personnel and their families, government entities, Docketwise and specified related people or entities, people who timely opt out, and people found guilty of or who plead no contest to criminal activity involving the incident.
Can I receive more than one settlement benefit?
You may choose either the reimbursement/lost-time option or the $50 alternative cash payment. The $50 payment cannot be combined with reimbursement for out-of-pocket losses or lost time.
Credit monitoring is separate from those payment choices. You may claim two years of one-bureau Kroll credit monitoring in addition to either payment option. The notice states an overall benefits cap of $5,000 per person.
What records do I need if I claim out-of-pocket losses?
For out-of-pocket losses, you may seek reimbursement for qualifying unreimbursed economic losses that are fairly traceable to the data incident. Examples listed in the notice include fraud or identity-theft losses, certain professional fees, credit-freeze costs, credit-monitoring costs, and small expenses such as postage or mileage.
You need third-party records showing the costs, such as receipts, invoices, credit-card statements, or phone bills. A handwritten receipt or other self-prepared record alone is not enough.
What do I need to claim lost time?
You may claim up to three hours spent dealing with the data incident, at $25 per hour, for a maximum of $75. Lost time may be claimed with out-of-pocket losses or instead of them.
You do not need receipts for the time claim. The notice requires an attestation—an affirmation on the claim form that you spent the claimed time responding to issues from the data incident.
Do I need documents to claim the $50 payment?
The $50 alternative cash payment does not require supporting records or an attestation. You still must file a claim, and choosing this payment means you cannot also receive out-of-pocket-loss reimbursement or lost-time payment.
How and when do I submit a claim?
To receive benefits, submit a claim form online by 11:59 p.m. Eastern Time on October 15, 2026, or mail it so it is postmarked by October 15, 2026. Include any supporting documents that apply to the benefit you claim.
The notice gives an online claim option and a mailing option. It does not describe the full contents of the claim form beyond the supporting-document and lost-time-attestation requirements stated in the notice.
When would I receive benefits or credit-monitoring information?
For credit monitoring, a person with a valid monitoring claim will receive an activation code by email or mail after final approval and after any appeals are resolved. The notice says the code will be sent within 14 days of that effective date and will remain usable for 180 days after it is mailed.
Cash or reimbursement benefits also depend on final approval and resolution of any appeals. The notice does not provide a specific payment date.
What happens if I opt out, and how do I do it?
Opting out means leaving the settlement. You would not receive settlement benefits, but you would keep the right to bring your own lawsuit about the claims released by this settlement.
To opt out, mail a signed written request for exclusion by September 15, 2026. It must include the case name and number, a clear statement that you want to opt out, your contact information, and your personal signature. Telephone and email opt-outs are not accepted.
Can I object without giving up a claim?
If you stay in the settlement, you may object to it. An objection tells the Court what you disagree with; it does not remove you from the settlement, and you may still file a claim.
To be considered, an objection must be filed with the Court and mailed to the Settlement Administrator by September 15, 2026. The notice lists required details, including proof that you are in the settlement class, the reasons for your objection, and your personal signature.
What happens if I do nothing?
If you do nothing, you will not receive any settlement benefits. Unless you timely opt out, you remain bound by the settlement and give up the right to sue Docketwise and the released parties over the released claims.
