Who Is Included

The settlement covers certain owners of U.S. or Canadian buildings with qualifying CertainTeed Organic Shingles, qualifying former owners with documented assigned claim rights, and certain people with prior warranty settlements. Payment also requires the applicable claim category and settlement criteria, including qualifying damage caused by a product defect.

Which shingles are covered?

  • Organic asphalt shingles made by CertainTeed from July 1, 1987 through 2005 may be included if they were sold under one of the listed names, such as Custom Sealdon, Sealdon, Hallmark Shangle, Horizon Shangle, Independence Shangle, Hearthstead, or Saf-T-Lok.
  • Some named brands were sold in both organic and fiberglass versions. Fiberglass shingles are not part of this case.

How can I tell whether my roof has the covered organic shingles?

  • Check roofing purchase, repair, warranty, sales, or product documents; ask the installer or repair company; look for leftover packaging; or consult an experienced roofer.
  • Another option is to have a roofing professional remove a shingle and send it to CertainTeed for identification. The notice says CertainTeed will reimburse up to US$50 of that expense only when it determines that the shingle was made by CertainTeed.

What must be shown for a payment claim?

  • Having covered shingles is not enough by itself.
  • The shingles must have qualifying damage before the warranty ends, and the available evidence must show that a product defect caused it rather than installation, maintenance, or another cause outside CertainTeed’s control.

  • An original purchaser or other current owner covered by the warranty generally may file until the original warranty period ends.
  • Some covered later purchasers may have only two years after acquiring the building, depending on the transfer terms of the original warranty.
  • A former owner with a valid documented assignment must file within 90 days after the property sale and before the original warranty ends.
  • The official page says the former 12-month routes for non-warranty purchasers and certain earlier warranty settlements expired on October 3, 2011.

How are payments for warranty-covered owners calculated?

  • A “square” means 100 square feet of roofing shingles.
  • For warranty-covered claims filed within 10 years of installation, the stated formula is US$40 per square without proration, plus US$34 per square reduced for the years of use and remaining warranty period.
  • For claims filed more than 10 years after installation but before the warranty ends, the stated formula is US$74 per square, prorated for use.
  • The payment also depends on the validity requirements, including the extent of damaged shingles, the warranty terms, and whether a defect caused the damage.

Are there special payment rules for later building buyers or people with an earlier warranty settlement?

  • A buyer of a building with covered shingles who is not covered by the warranty may receive US$34 per square for replacement shingles, labor, and other materials, reduced from the installation date for years of use.
  • A person who settled a qualifying warranty claim on or after August 1, 2006 may receive 20% of the difference between the earlier warranty payment and the greater amount they would have received under the settlement.

  • The official materials do not promise a specific payment date.
  • If CertainTeed denies a claim, the notice says the claimant may appeal to an Independent Claims Administrator.

What happens if I do nothing?

  • If you stay in the class and do not submit a claim, you receive no payment.
  • If the settlement is approved, you generally give up the right to sue CertainTeed later over the issues resolved in this case.
  • The notice says participants may still pursue compensatory-damages claims for damage to interior parts of the building below the roof deck or for personal injury believed to result from premature shingle deterioration. It excludes attorneys’ fees, penalties, punitive damages, and other damages beyond compensatory damages in connection with those claims.

What was the difference between opting out and objecting?

  • Excluding yourself, also called opting out, means leaving the settlement. You cannot receive a settlement payment or object, but you keep any right you may have to bring your own lawsuit about the shingles.
  • The written exclusion request had to be mailed or delivered by May 11, 2010. It needed the case caption, the property address or addresses, the number of relevant structures at each address, and required signatures.
  • Objecting means telling the court what you oppose about the settlement while remaining in it. The objection deadline was April 26, 2010.
