Bayhealth Portal Privacy Settlement: What Claimants Got

The notice defines the class by both portal-user status and use of the specified web properties. If you are unsure whether you are included, the notice says you may contact the Settlement Administrator for free help.

• You must be a Bayhealth patient portal user who used the defined Bayhealth Web Properties by December 31, 2025.
• Those Web Properties include Bayhealth.org pages that link by button to the MyChart login page, as well as the MyChart portal itself, during January 1, 2019 through December 31, 2025.
• Bayhealth and its officers, directors, and related companies are excluded. So are people who opt out, and the judge, the judge’s family, and staff.

The benefits are not alternatives. A class member may submit a claim for either benefit or for both. CyEx Privacy Shield includes privacy tools such as dark-web and compromised-password scans, a virtual private network (VPN), and a password manager. It also offers access to a fraud-resolution agent if suspicious activity occurs.

• One year of CyEx Privacy Shield.
• A one-time $25 cash payment.

Submit a valid and timely Claim Form to seek benefits. The notice specifically waives proof or an explanation for the cash payment, but it does not give further documentation instructions for the privacy-service enrollment.

• The $25 payment does not require proof or an explanation.
• A Claim Form is still required to receive either benefit.
• The notice does not say whether any supporting documents are needed to enroll in CyEx Privacy Shield.

The notice identifies online submission as the fastest method. It gives the Settlement Administrator’s mailing address as Bayhealth Pixel Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958.

• Submit online by October 5, 2026.
• Or download, complete, sign, and mail a Claim Form. A mailed form must be postmarked by October 5, 2026.
• You may request a paper Claim Form by phone, email, or mail from the Settlement Administrator.

The final approval hearing is scheduled for October 29, 2026, at 10:00 a.m. Eastern Time. The notice does not give a specific distribution date because an appeal could delay payment or benefits.

• Benefits are not due immediately.
• The Court must first grant final approval.
• Any appeals must also be resolved before settlement payments are distributed.

Opting out means leaving the settlement. You will not receive settlement benefits, but you keep any rights you may have to bring your own lawsuit about the legal issues in this case.

• Send a written Request for Exclusion by mail or email no later than September 4, 2026.
• Include the case name, your full name, mailing address, telephone number, email address, personal signature, and a clear statement that you want to be excluded.
• An exclusion request applies only to yourself, not another person.

You may still file a claim for settlement benefits if you object. If you opt out instead, you cannot object because the settlement no longer affects you.

• Objecting asks the Court not to approve some or all of the settlement. It is different from opting out.
• Only class members who do not opt out may object.
• A complete objection must be filed with the Clerk of Court by September 4, 2026, and a copy must also be sent to the Settlement Administrator.
• The objection must identify the case, provide your contact details and proof of class membership, explain your reasons, and include your signature. The notice lists additional information required if you have a lawyer or made objections in other cases during the last three years.

The notice directs readers to Section IX of the Settlement Agreement for the full list of claims released. It does not set a deadline for doing nothing.

• You will not receive either settlement benefit.
• Unless you opted out, you remain in the settlement and give up the rights described in the settlement’s release of claims.
