Questions & Answers
Which products does the notice list?
The notice limits the settlement to the listed Lotrimin and Tinactin spray products that were part of Bayer’s October 2021 recall. It further identifies recalled products by lot numbers beginning with TN, CV, or NAA.

- Lotrimin Anti-Fungal (AF) Athlete’s Foot Deodorant Powder Spray

Who is excluded from the settlement class?
The notice also says a person must be in the United States and have purchased an eligible product in the United States to be a Settlement Class Member. The notice contains conflicting purchase and product-date descriptions; see the issue above.
- Officers and directors of the defendants and certain related entities
- People who bought products only to resell them to consumers
- The judge assigned to the case, that judge’s staff, and immediate family members
- Settlement Class Counsel, their staff, and immediate family members
- People who timely and properly exclude themselves
What payment options are available, and can I use both?
These are alternatives. A claimant may use one option or the other, not both.
- Proof-of-Purchase Payment: Submit a valid claim form and valid proof of purchase. The payment is the documented purchase price, not including sales tax.
- No Proof-of-Purchase Payment: Submit a valid claim form and attest under penalty of perjury that you bought eligible products. The payment is $7 for each product claimed, with no more than three units per household.
Could the payment amount change?
So neither the documented-price amount nor the $7-per-product amount is necessarily the final amount paid.
- If the available net fund is too small for all valid claims, payments will be reduced proportionally.
- If money remains after the initial calculation, payments will be increased proportionally.
What happens if my household received money through Bayer’s Recall Program?
The offset can apply when either the claimant or someone in the claimant’s household had an approved Recall Program claim.
- A payment under this settlement will be reduced by the amount received through the Recall Program, but not below zero.
- The notice provides a limited exception: after three Recall Program payments, a person who attests to additional eligible purchases may be eligible for one no-proof-of-purchase payment.
How do I submit a claim, and what is the deadline?
A claim form is required for either payment option. The notice says forms may be submitted electronically or by mail.
- Online: submit the form by 11:59 p.m. Hawaii-Aleutian Standard Time on March 11, 2026.
- By mail: send the form to the Settlement Administrator at the address in the notice, postmarked no later than March 11, 2026.
When might payments be sent?
The notice does not promise a payment date. It says the administrator will begin processing approved claims no later than 90 days after the settlement receives final approval.
- The Court must grant final approval.
- Any appeals or other legal challenges must be resolved.
- The settlement must not be terminated for another reason.
- The Settlement Administrator must find the claim valid.
What happens if I do nothing?
To receive a payment, a claim form must be submitted by the stated deadline.
- You will not receive a cash payment.
- If the settlement is approved, you will generally be bound by its release of the claims covered by the case, whether or not you submit a claim.
- The notice states that claims for personal injury are not included in the released claims.
How do I exclude myself, and what changes if I do?
Leaving the settlement means no payment from it, but it preserves the right to pursue a separate lawsuit about the matters at issue.
- Mail a signed written exclusion request; electronic opt-outs are not allowed.
- Include your full name, phone number, current address, a clear statement that you want to be excluded, and the case name and number.
- Write “EXCLUSION REQUEST” on the lower-left corner of the envelope.
- The request must be postmarked by March 11, 2026.
Can I object to the settlement and still seek a payment?
An objection does not remove a person from the settlement. Someone who objects may still submit a claim form.
- Only people who remain in the settlement class may object.
- File a written objection with the Court under its filing procedures and serve it by U.S. mail to the Court by March 11, 2026.
- The objection must include the information and statements listed in the notice, including the objector’s contact information, signature, reasons, and whether the person plans to attend the hearing.
When is the final approval hearing, and may I speak?
The Court may change the hearing date, time, or format.
- The hearing is scheduled for May 13, 2026, at 9:30 a.m.
- It is scheduled before Judge Stanley R. Chesler in Courtroom PO No. 2, Senator Frank R. Lautenberg Building, 2 Federal Square, Newark, NJ 07101.
- Attendance is optional.
- A person who wants to speak must say so in an objection or file a Notice of Intention to Appear by March 11, 2026.
