RevitaLash Lash and Brow Serum Settlement: What It Paid

The settlement covers people who bought any formulation of these listed products in the United States between January 1, 2017, and December 29, 2025. The notice does not say that receiving a notice by mail or email proves that someone qualifies; it says those people were identified as possible purchasers from available records.

A claim form is required for either a cash payment or voucher. The notice says that, in general, a claimant selects either a cash benefit or a voucher. It specifically allows a claimant who submits proof of purchase to choose both a single cash benefit and a single voucher.

The notice does not clearly say whether a person listed in Athena’s records, but without proof of purchase, can receive both benefits.

• Submit a timely, valid Claim Form.
• Choose a cash benefit or a voucher.
• If you have proof of purchase, include it if you want the option to elect both one cash benefit and one voucher.

The notice does not identify the documents or other materials that count as valid proof of purchase. It only states the effect of having, or not having, valid proof.

• For a cash payment for each product claimed, you must either appear in Athena’s records or provide proof of purchase.
• Without valid proof of purchase, cash payments are limited to one per household.
• Without valid proof of purchase, vouchers are also limited to one per household.

The voucher is a code that must be entered when making an online purchase. If voucher claims exceed the $1,134,000 voucher fund, the administrator can require proof of purchase for all voucher claims. If the total still exceeds that fund, cash-fund money may be used for vouchers, but not in a way that takes an authorized claimant’s selected cash benefit below $20.

• The voucher is a $110 credit toward products Athena sells through its e-commerce website.
• It does not expire and can be transferred to someone else.
• It can be used with other discount codes, promotions, or gift cards.
• It does not have to be spent in one purchase.

The settlement also includes a separate $1,134,000 voucher fund. The stated $4,170,000 total is made up of these two funds, not a guaranteed payment amount for each claimant.

• The cash fund is $3,036,000, but the notice does not set a fixed payment amount for an individual.
• The amount depends in part on the number of timely, valid claims and on amounts the Court approves for specified fees, costs, expenses, and service payments.
• A qualifying claimant who is in Athena’s records or provides proof of purchase may seek payment for each product claimed.

The notice does not describe every field or supporting item required on the claim form. It says the claim must be timely and valid.

• You may submit the form online.
• You may mail a paper form; it must be postmarked by April 20, 2026.
• The notice says a paper form can be requested through the settlement website or by calling the toll-free number.

Payments may be sent electronically, such as through PayPal, Venmo, or Zelle, or by paper check. The May 21, 2026 hearing is scheduled to consider approval; it is not itself a promise that payments will be made then.

• The Court must approve the settlement.
• Any appeals must be resolved in favor of approval, if there are appeals.
• Approved claimants are to receive payment within 21 days after final approval and/or after the appeals process is complete.

Leaving the settlement is sometimes called opting out. A person who opts out cannot receive settlement benefits, but may be able to sue or continue suing Athena separately over the claims at issue. The notice provides the required exclusion statement and mailing address.

• If you do nothing, you remain in the class but receive no payment.
• If the settlement is approved, you give up the ability to sue Athena separately over the claims resolved by this settlement.
• To leave the settlement, mail a signed and dated exclusion request with your name, current address, and telephone number. It must be postmarked by April 20, 2026.

The final approval hearing is scheduled for May 21, 2026, at 10:00 a.m. in Courtroom 5B at the First Street U.S. Courthouse in Los Angeles. Attendance is not required for an objection that was properly filed and mailed on time.

• You can object only if you stay in the class.
• A written objection must explain the reasons and support for it, include the required personal and class-membership information, and be signed.
• It must be filed with the Court and copies mailed to the listed lawyers by April 20, 2026.
• To ask to speak at the hearing, include your intention to appear in the written objection.

These changes happen only if the settlement becomes final. They are not a claim payment or voucher.

• Athena is to put the specified label changes on products in production no later than 120 days after the Settlement Date.
• The contemplated website changes are also to be implemented by then.
• Existing packaging may continue to be used, and Athena may sell its existing inventory with current labels.
• The changes are to remain in effect for at least two years, with limited stated exceptions.
