People identified by Olinsky & Associates as affected by its January 2025 data incident are set to receive a $40 payment and three years of monitoring under a proposed class action settlement. No claim form is required. The benefits would become available only after the court grants final approval and any appeals are resolved.

Who is included

The settlement class covers people Olinsky identified as impacted by the incident, including those who were sent an incident notice. Olinsky, certain related people and entities, and the judge and court staff involved in the case are excluded. The case is Leon-Roman v. Olinsky & Associates, PLLC in the U.S. District Court for the Northern District of New York.

Automatic settlement benefits

Class members who do not opt out are due both of the following benefits:

  • A $40 check mailed automatically.
  • Three years of CyEx Financial Shield Complete, including one-bureau credit monitoring, financial-account monitoring, authentication alerts, fraud-resolution support and up to $1 million in identity-theft insurance.

The monitoring service requires an enrollment code, but not a settlement claim. The notice says codes were sent by postcard and directs anyone who no longer has a code to contact the Settlement Administrator. Olinsky also agreed to maintain security-related business-practice changes.

Dates and choices

There is no claim deadline because there is no claim process. The deadline to opt out or object is October 26, 2026. Opting out gives up the settlement benefits but preserves any right to pursue a separate case about the released issues. Remaining in the settlement gives up the right to bring another lawsuit against Olinsky over those issues.

The final approval hearing is scheduled for December 2, 2026 at 10:00 a.m. in Syracuse, New York. The official settlement website says the hearing schedule may change, so class members considering participation should check it for updates.
