Costco Washington Commercial Email Settlement: Who Qualified and What It Paid

• You may be included if all of these are true:
• You received a commercial email sent by Costco or on Costco’s behalf between June 2, 2021, and July 7, 2026.
• You lived in Washington when you received it.
• The message was sent to an email address that appears in Costco’s data.
• Getting a notice is not required. A person who did not receive one may still be included if they meet these conditions.
• Costco, entities controlling Costco, certain current or former Costco-related people and their immediate families, and people who validly exclude themselves are not included.

No dollar amount is guaranteed or stated in the notice. Eligible people with timely, valid claims will divide the remaining fund equally. The amount left for claims will be lower after settlement costs and any court-approved attorneys’ fees, expenses, and service award are deducted.

You can submit only one claim, even if you received more than one qualifying email. The notice therefore does not provide a separate payment for each email.

• Complete one Claim Form by August 24, 2026.
• Provide a Claim ID if you have one, the email address or addresses where you received the messages, and contact information.
• Attest that you received qualifying Costco email, lived in Washington when you received it, and owned the listed email address at that time.
• Choose an available payment method. The notice lists paper check, Venmo, PayPal, and other options on the form.
• The notice does not state that supporting documents must be submitted with the claim. If an email address cannot be verified, the administrator may contact you for a different address.

You may submit the completed form online or mail it to the Settlement Administrator. A mailed claim must be postmarked by August 24, 2026.

Do not submit the same claim both online and by mail. Duplicate claims will be rejected.

If you stay in the settlement but do not file a claim, you will not receive a payment. If the settlement is approved and becomes final, you will still be bound by it and will give up the right to sue Costco separately over the issues covered by this case.

The release described in the notice covers claims, whether known or unknown, relating to Costco commercial emails sent to any email address that were or could have been brought in this lawsuit, as well as claims based on the same underlying facts.

• You may submit a written objection or comment if you are a class member and have not excluded yourself.
• It must include your contact information, why you believe you are a class member, the email address or addresses where you received Costco email, your specific objection or comment, and your signature. The notice lists additional requirements if you have a lawyer or plan to appear, call witnesses, or offer exhibits.
• The notice says to send it to the Settlement Administrator by mail or email no later than August 24, 2026. See the issue above regarding the notice’s unclear timing language for emailed submissions.

The fund is $14 million, but it is not all reserved for class-member payments. It also pays court-awarded attorneys’ fees and litigation expenses, any service award to the class representative, and settlement costs deducted before payments are calculated.

The notice says uncashed or undeliverable payments may be used for a second proportional distribution to people who received or cashed their first payment, if the remaining funds justify the administrative cost. Funds may also go to the Legal Foundation of Washington.

The final approval hearing is scheduled for October 2, 2026, at 3:30 p.m. in King County Superior Court, Courtroom W728, 516 Third Ave., Seattle, Washington 98104.

You do not have to attend to receive a payment. The court may move the hearing or hold it remotely, and the notice does not say how long final approval and later payment steps will take.
