Who is included in this settlement?

  • You may be included if you live in the United States and your private information was potentially affected in VSHSI’s October 2025 data incident. This includes people who received a notice about the incident.
  • You are excluded if you validly opt out, are VSHSI or one of its officers, directors, or related companies, are the judge or the judge’s family or staff, or perpetrated the incident.

What benefits can I claim, and can I receive more than one?

  • All class members may claim two years of CyEx Medical Shield Complete. It includes $1 million in medical identity theft insurance and monitoring for healthcare insurance ID exposure, Medical Record Number exposure, and unauthorized Health Savings Account spending.
  • You may also choose cash benefits. You can seek documented out-of-pocket losses and lost-time compensation, or choose the $50 alternative cash payment instead of any other payment.

What do I need to claim out-of-pocket losses?

  • You may claim up to $3,500 for actual out-of-pocket losses caused by the data incident that occurred from October 7, 2025, through January 18, 2027.
  • Examples include identity-theft or fraud losses, certain credit-related fees, ID replacement costs, and postage for contacting banks.
  • You must provide supporting records, such as bank statements or receipts. Notes or papers you made yourself may support other evidence but cannot be the only proof. You cannot claim expenses already reimbursed by someone else.

Can I get paid for time I spent dealing with the incident?

  • You may claim up to four hours spent responding to the incident, at $20 per hour, for a maximum of $80.
  • Covered examples include changing passwords, checking suspicious account activity, and researching the incident.
  • The notice does not specifically say what documents, if any, are required for a lost-time claim. A valid Claim Form is required for settlement benefits.

What is the $50 alternative cash payment?

  • The alternative payment is a one-time $50 cash payment.
  • You do not need to provide proof or an explanation for this payment.
  • Choosing it means you cannot also claim the other cash payments, including documented losses or lost time. You may still claim the monitoring service.

Could my cash payment be reduced?

  • The total available for monetary benefits is capped at $500,000.
  • If approved claims for money exceed that cap, each person’s monetary payment will be reduced proportionally. The notice does not promise that a claimant will receive the full listed amount.

How and when do I file a claim?

  • Submit a completed Claim Form online, or download a form and mail it to the Settlement Administrator.
  • Online claims must be submitted by January 18, 2027. Mailed claims must be completed, signed, include supporting documentation, and be postmarked by January 18, 2027.
  • You can request a paper Claim Form by phone, email, or mail.

What happens if I do nothing?

  • If you do nothing, you will not receive any settlement benefit or payment.
  • Unless you opt out, you will remain in the settlement and give up the right to bring or continue another lawsuit against VSHSI over the claims covered by this settlement.

What does opting out mean, and what is the deadline?

  • Opting out means formally leaving the settlement. You will not receive settlement benefits, but you keep any rights you may have to sue VSHSI yourself about the legal issues in this case.
  • Your exclusion request must include the case name and number, your contact information, your personal signature, and a clear statement that you do not want to participate.
  • The request must be submitted, postmarked, or emailed by January 4, 2027.

When will benefits be issued?

  • The Court has not yet approved the settlement. The final approval hearing is scheduled for February 2, 2027, at 9:00 a.m. Central Time by Zoom.
  • Even if the Court approves the settlement, benefits will be distributed only after any appeals are resolved. The notice does not give a payment date.
