Questions & Answers
Who is included in the settlement?
This settlement is for people who received notice about the Vasindas data incident and meet the class definition. Receiving the notice is an important part of the definition.
- You must be a living U.S. citizen who was sent notice that personal information was actually or potentially accessed or compromised in the January 2024 Data Incident.
- The notice excludes the judge and the judge’s family and staff; the lawyers in the case and their families and staff; government entities; Vasindas and related people and companies; people who opt out validly; and anyone who caused the Data Incident.
Can I receive medical monitoring and a cash payment?
The two cash options are alternatives, so you cannot receive both. Medical monitoring is offered in addition to the cash option you choose.
- You may choose one cash-payment option: up to $2,500 for qualifying documented losses, or a one-time $70 alternate cash payment.
- You may also enroll in two years of CyEx Medical Shield Complete. The notice says all class members may enroll in medical monitoring and claim one of the two cash options.
What does the up-to-$2,500 documented-loss payment cover?
The documented-loss option may cover items such as identity-theft or fraud losses, certain credit-related fees, replacement-ID costs, and postage used to contact banks by mail.
- The payment is limited to actual out-of-pocket losses caused by the Data Incident.
- Eligible losses must have occurred from January 30, 2024, through November 23, 2026.
- The maximum payment is $2,500.
- You cannot claim an expense that another party has already reimbursed.
What proof do I need for a documented-loss claim?
This documentation requirement applies to the documented-loss option. It does not apply to the $70 alternate cash payment.
- Send records such as bank statements or receipts that show what you spent or lost.
- The records or accompanying information should show that the expense resulted from the Data Incident.
- Notes or papers you prepared yourself may help explain other evidence, but they cannot be the only support for a valid claim.
What is the $70 alternate cash payment?
You still need to submit a valid and timely Claim Form to receive settlement benefits or payments.
- The $70 payment is a one-time alternate cash payment.
- You do not need to provide proof or an explanation for this option.
- It is available instead of the documented-loss payment.
How and when do I submit a claim?
The notice says a valid and timely Claim Form is required to receive benefits or payments.
- Submit a Claim Form online by November 23, 2026, or download a form and mail it to the Settlement Administrator.
- A mailed claim must be completed and signed. For a documented-loss claim, include the supporting records.
- A mailed claim must be postmarked no later than November 23, 2026.
How does medical monitoring work?
The notice offers two years of CyEx Medical Shield Complete. It includes monitoring for healthcare insurance ID exposure, medical record number exposure, and unauthorized Health Savings Account spending, plus access to a fraud-resolution agent if suspicious activity occurs.
- Enrollment codes were sent to class members by postcard.
- If you no longer have your code, contact the Settlement Administrator.
- The subscription will become active once the Court grants final approval.
What happens if I opt out of the settlement?
Opting out means leaving the settlement. You will not receive settlement benefits, but you keep any rights you may have to bring your own case against Vasindas about the issues involved.
- To opt out, send a Request for Exclusion that identifies the case, gives your contact information, includes your personal signature, and clearly says that you do not want to participate.
- Mail it to the Settlement Administrator’s exclusion-request address.
- It must be submitted, postmarked, or emailed by October 26, 2026.
When will payments and medical monitoring begin?
The notice does not give a specific payment date. It says appeals may occur and that their timing is unknown.
- The Court has not yet approved the settlement.
- The final approval hearing is scheduled for December 3, 2026, at 8:30 A.M. Pacific Time in Department T-2 of the Superior Court for Kern County, California, 1415 Truxtun Ave, Bakersfield, California.
- Payments will be distributed only if the Court grants final approval and after any appeals are resolved.
