Who Is Included

The settlement covers people who received a direct-mail notice from Total Vision about the October 30, 2020 Data Security Incident at a California address. Only people on the Settlement Class List may file a claim, and people who validly opt out cannot receive settlement benefits.

Questions & Answers

Can I request both the pro-rata payment and expense reimbursement?

Yes. A qualifying class member may request both types of cash benefit on one claim form: a pro-rata cash payment and reimbursement of eligible documented expenses up to $1,000. The expense reimbursement is not guaranteed at $1,000 and may be reduced if approved expense claims are too large.

Do not submit a request to be excluded if you want either payment. The notice says that if both a claim form and an exclusion request are sent, the exclusion request will be disregarded and the claim will be processed.

What kinds of expenses may qualify for reimbursement?

The notice gives examples of expenses that may qualify if they are fairly traceable to the incident, were actually incurred from October 30, 2020 through October 5, 2026, and were not already reimbursed by someone else. Your own lawyer fees and costs do not qualify.

There is a narrower date rule for credit-monitoring and identity-theft-protection services: those expenses must have been incurred from February 28, 2022 through October 5, 2026.

What do I need to submit, and do I need documents?

A claim for the pro-rata cash payment does not state a requirement to submit supporting loss documents. However, expense reimbursement requires documents supporting each claimed expense. A missing required document means the expense-reimbursement claim will be denied.

Only people on the Settlement Class List may submit a claim. The notice says a person who received the settlement postcard has been identified on that list.

  • For a pro-rata cash payment, complete a claim form and submit it online or mail it by October 5, 2026.
  • For expense reimbursement, mail the claim form and supporting documentation. This part cannot be filed online, by phone, or by email.
  • For an expense claim, complete Section II, provide the requested information in Section IV, sign the Section V attestation, and include reasonable documentation for every claimed loss or expense.

Why is the pro-rata payment amount unknown?

There is no fixed dollar amount for the pro-rata cash payment. The settlement fund starts at $475,000 plus interest, but court-approved taxes, administration costs, representative awards, and class counsel fees and expenses are deducted. Approved expense reimbursements are then deducted before the remaining money is divided among people with valid pro-rata claims.

Expense reimbursements may also be reduced proportionately depending on the total approved expense claims.

When and how would payment be sent?

The settlement still needs final court approval. If it becomes effective, your timely, valid claim is approved, and you did not opt out, the administrator will process payment within 60 days after the Effective Date. The notice explains that the Effective Date occurs after final approval.

Payments are normally mailed as checks. On the claim form, a person seeking the pro-rata payment may instead choose PayPal, Venmo, or Zelle by providing the email address linked to that account. Initial checks expire 120 days after issuance.

What happens if I do nothing or choose to leave the settlement?

If you do nothing, you will not receive either cash benefit because a claim form is required. If the settlement receives final approval, you will remain in the settlement class and give up the covered claims against Total Vision, the other defendants, and released persons.

To leave the settlement, mail a written exclusion request postmarked by September 4, 2026. Leaving means you cannot receive settlement benefits or object, but you will not be bound by the settlement release. The request must include your full name, current mailing address, signature, and a statement requesting exclusion from this case.

Do I need to make a claim to receive the data-security benefit?

The security improvements are a class-wide benefit; no claim form is required for that benefit. The notice says Total Vision will provide improved data-security measures for at least two years, with costs separate from the $475,000 settlement fund.
