Texas Retina Data Settlement

This proposed settlement concerns unauthorized access to Texas Retina Associates systems and files containing personal and health information. People covered by the settlement can submit a claim for the available benefits. They may also object to the proposal or opt out, which means leaving the settlement and keeping the right to bring their own lawsuit about the claims being resolved.

Who Is Included

You may be included if your Private Information was accessed and/or acquired by an unauthorized party in the Data Incident Texas Retina Associates reported in April 2024, including if the company sent you a Data Incident notice on or around June 28, 2024. Texas Retina Associates, the presiding judge, and that judge’s staff and family are excluded.

  • Proof required: A documented expense claim requires necessary supporting documentation. The $45 cash payment does not require documentation of losses, and identity theft protection does not require supporting documentation. A Claim Form is required for money or identity theft protection, and the notice says a Class Member ID and PIN are needed to access online and paper forms.

Who is included in the Settlement Class?

The notice describes the covered group as Settlement Class Members. Receiving the June 2024 notice is specifically included in the description of the group.

  • The company’s Private Information was accessed and/or acquired by an unauthorized party in the April 2024 Data Incident.
  • This includes people who were sent Texas Retina Associates’ Data Incident notification on or around June 28, 2024.
  • Texas Retina Associates, the presiding judge, and that judge’s staff and family are excluded.

What benefits can I request, and can they be combined?

You may choose either the documented-expense reimbursement or the $45 cash payment. The notice separately says class members may elect the identity theft protection, so it can be requested with either money option. All of these benefits require a Claim Form.

  • Up to $4,000 for certain documented out-of-pocket expenses caused by the Data Incident.
  • A $45 cash payment instead of a documented-loss claim.
  • Three years of identity theft protection, including monitoring from one credit bureau and $1 million in identity theft protection insurance.

Do I need documents to make a claim?

A Claim Form is still required for every benefit. Documents are required only if you seek reimbursement for documented expenses.

  • For the expense-reimbursement option, send the necessary supporting documents with a timely valid claim.
  • For the $45 cash option, you do not need to document Data Incident losses.
  • For identity theft protection, no supporting documents are needed.

How do I submit a claim, and what is the deadline?

The Claims Administrator will review claims. The notice does not describe how long that review or later benefit delivery will take.

  • Submit a Claim Form online by November 30, 2026, or mail it with a postmark no later than November 30, 2026.
  • The notice says the Class Member ID and PIN printed on your notice are required to access either the online or paper Claim Form.
  • You can obtain a form through the settlement website, by email, or by calling the Claims Administrator.

What does it mean to exclude myself from the Settlement?

Opting out means leaving the settlement. It is the option for someone who does not want to be bound by the settlement’s release of claims.

  • Send an individually signed written request that clearly says you want to be excluded.
  • Mail it to the Claims Administrator with a postmark no later than October 30, 2026.
  • If you opt out, you cannot receive settlement cash benefits or object, but you keep the right to bring your own lawsuit about the claims this settlement resolves.

What happens if I do nothing?

Doing nothing is different from opting out. It does not preserve your right to sue about the settled claims.

  • You will not receive money from the settlement.
  • If the Court approves the settlement, you will be bound by it and cannot bring or continue a lawsuit about the claims being settled.
  • The notice also says doing nothing releases the claims described in Question 8.

How must an objection be delivered by the deadline?

The notice gives conflicting delivery wording. Its opening summary says objections must be postmarked by October 30, 2026. Question 15 instead says the objection sent to the Clerk of the Court must be received by October 30, while copies sent to the Claims Administrator and counsel must be postmarked by that date.

Because the notice makes receipt by the Clerk the stricter instruction, do not rely only on an October 30 postmark for the Clerk copy. Review Question 15 for every required recipient and item, and contact the Claims Administrator if you need clarification.
