Jane Doe v. Saint Francis Hospital: Tenet Pixel Settlement

The proposed settlement resolves claims that Tenet Healthcare used third-party tracking pixels on its website in a way that violated privacy law, covering patients of Saint Francis Hospital-Memphis and other Tenet facilities. Every class member can claim a one-time $16.00 cash payment and enroll in two years of CyEx Privacy Shield Pro identity protection, whose enrollment codes were mailed on postcards. Claims are due March 15, 2027 and the final approval hearing is January 14, 2027; the notice states no settlement total, and the court has not yet given final approval.

Questions & Answers

Who is covered by this settlement?

The settlement concerns certain uses of Tenet Healthcare online platforms. The notice’s definition is narrower than simply visiting a website: it identifies particular online activities during the class period.

  • You must be an “Identifiable Individual” who used a Tenet Healthcare, affiliated covered entity, or former affiliated entity website or patient portal during the class period to create a patient-portal account, submit a webform, or check in to urgent care or an emergency room.
  • The class period is January 1, 2017, through September 18, 2023.
  • The notice excludes the judge and the judge’s family and staff; Tenet Healthcare and certain related people and companies; attorneys for the parties; and people who validly opt out.

What benefits are available, and can I get both?

The notice says class members may claim one benefit or both. The two benefits are not alternatives.

  • Two years of CyEx Privacy Shield Pro, a privacy service with dark-web scanning, compromised-password scanning, a VPN, password manager, other privacy tools, and access to a fraud-resolution agent if something suspicious occurs.
  • A one-time $16.00 cash payment.

Do I need proof or an enrollment code to receive a benefit?

The notice does not require supporting documents for the cash payment. An enrollment code is needed for the privacy-service enrollment, but the notice says the administrator can help if the code is missing.

  • For the $16 cash payment, the notice says you do not need to provide proof or an explanation.
  • For CyEx Privacy Shield Pro, enrollment codes were sent by postcard. If you no longer have your code, contact the Settlement Administrator.
  • A valid and timely Claim Form is still required to receive settlement benefits or payments.

How do I submit a claim, and what is the deadline?

The notice does not describe what information a Claim Form must contain or how a claim is evaluated beyond saying that it must be valid and timely. It says you may call, email, or write to the Settlement Administrator to request a paper form.

  • Submit a Claim Form online, or download a printable form and mail it to the Settlement Administrator.
  • Online forms must be submitted by March 15, 2027.
  • Mailed forms must be completed, signed, and postmarked by March 15, 2027.

When will benefits or the cash payment be sent?

The final approval hearing is scheduled for January 14, 2027, but that hearing date is not a promise that benefits will be issued then. The Court may approve or not approve the settlement, and any appeals must be resolved before distribution.

  • Benefits will be issued only if the Court grants final approval.
  • Appeals could delay distribution, and the notice does not give a payment or benefit-issuance date.

What happens if I opt out of the settlement?

Opting out means leaving the settlement. It is different from objecting: a person who opts out cannot object to the settlement.

  • To opt out, send a written Request for Exclusion by December 22, 2026.
  • It must identify the case; include your name, mailing address, phone number, email address, and personal signature; and state that you want to be excluded.
  • You may submit it by mail or email, but you may only opt out yourself—not another person.
  • If you opt out, you cannot receive settlement benefits, but you keep any rights you may have to bring your own case about the legal issues involved.

Can I object to the settlement instead of opting out?

An objection tells the Court why you think it should not approve all or part of the settlement. You may still file a claim for benefits if you object.

  • You may object only if you remain in the settlement; people who opt out cannot object.
  • Your written objection must be filed with the Clerk of Court by December 22, 2026.
  • You also must send copies to the Settlement Administrator, Class Counsel, and counsel for the Defendant.
  • The objection needs identifying and contact information, proof that you are a class member, your reasons, and a signature, among other listed details.

What if I do nothing?

Doing nothing does not preserve a right to receive benefits later. It also does not remove you from the settlement.

  • You will not receive either settlement benefit.
  • Unless you opt out, you remain in the class and give up the rights described in the settlement’s release of claims.
