Which website dates apply to me?
Check the web-property tables to match the site you used with its specific end date. The notice does not make every Prime website use through October 18, 2023 eligible.
- You must be a patient of Prime Healthcare and a listed Relevant Hospital, and you must have accessed or used that hospital’s listed web property during its own Class Period.
- All listed sites begin November 1, 2019, but their end dates differ. For example, the table lists January 27, 2023 for centinelamed.com and October 18, 2023 for shastaregional.com.
- The notice also excludes certain court-related and Prime-related people and entities, Class Counsel, and people who validly opt out.
What benefits are available to the two subclasses?
The cash payment is limited to the Patient Portal Subclass. Both subclasses are described as receiving a code for the monitoring service.
- People in the Patient Portal Subclass can seek both benefits: the $20 payment requires a valid, timely Claim Form, while the one-year CyEx Medical Shield Pro service is provided through a code with the notice.
- The separate Email Subclass covers people who were patients at a Prime Healthcare California hospital from November 1, 2021 through the applicable Class Period and gave Prime Healthcare an email address. That group receives the one-year service, not the $20 payment based on this definition.
- The notice does not say that these two subclass definitions cannot overlap.
What do I need to do to request the $20 payment?
The notice does not state what information or supporting documents the Claim Form itself requires to be considered valid. It only says that the form must be valid and timely.
- Only a Patient Portal Subclass Member may submit a claim for the $20 payment.
- An online claim must be submitted by December 21, 2026. A mailed, completed, signed Claim Form must be postmarked by that date.
- The notice permits an online form or a mailed form. It also says a paper form can be downloaded or requested from the Settlement Administrator.
What is required to use the CyEx Medical Shield Pro service?
The code is unique to the recipient and should not be shared, according to the notice.
- No Claim Form is needed for CyEx Medical Shield Pro. Eligible Patient Portal and Email Subclass Members receive an activation code with their notice.
- You must activate the code within 180 days of issuance. The notice gives April 20, 2027 as the enrollment deadline.
- Enrollment calls for the code plus your name, address, date of birth, telephone number, valid email address, and Social Security number. The notice says this information is needed for the service’s full benefits.
What happens if I do nothing?
People who are Settlement Class Members but belong to neither subclass receive no cash payment or CyEx code. Their settlement benefit is the website-tracking restrictions described in the notice.
- If you do nothing, you will not receive the $20 cash payment.
- If your notice included a CyEx code, you may still use it, provided you enroll on time.
- You remain in the Settlement Class unless you opt out, and give up the rights described in the notice’s release section.
How do I opt out, and what does that change?
Opting out means leaving the settlement. It is different from objecting: people who opt out cannot object.
- To leave the settlement, send a Request for Exclusion that says you want to be excluded and includes your name, address, and either an email address or phone number.
- You may send it by mail or email. It must be submitted, postmarked, or emailed by December 21, 2026.
- If you opt out, you receive no settlement benefits and cannot use the CyEx code, but you keep any rights you may have to bring your own case about these issues.
How can I object to the settlement?
An objection tells the Court why you support or oppose some or all of the settlement. It does not remove you from the settlement.
- You may object only if you stay in the Settlement Class; a person who opts out cannot object.
- The notice lists January 20, 2027 as the objection deadline. It says comments or objections may be mailed, faxed, or emailed to the Settlement Administrator, or made in person at the Final Approval Hearing.
- The hearing is scheduled for March 9, 2027, at 10:00 a.m. Pacific Time, at the Spring Street Courthouse in Los Angeles. You do not have to attend for a timely filed objection to be considered.
When would cash payments be sent?
The March 9, 2027 hearing is when the Court is scheduled to consider final approval. A hearing date does not guarantee that the settlement will be approved or that payments will be issued then.
- The Court must first grant final approval. Appeals may also be filed, and the notice does not say how long any appeal process would take.
- Cash payments will be distributed after final approval and after any appeals are resolved.
- The CyEx enrollment code is already included with the notice for eligible recipients, but enrollment must occur by the stated deadline.
