Questions & Answers
What documents do I need to submit for a refund?
You must submit both documents. BMV will then check its records to confirm the purchases you identify and your eligibility. If BMV cannot confirm that information, it will not issue a refund.
- A signed Declaration of Eligibility form, made under penalty of perjury.
- A copy of the VA letter showing a 100% service-connected disability rating and the date that determination was made.
How and when do I send my Eligibility Documentation?
The Settlement Administrator must receive the documents by 11:59 pm on December 2, 2026. Late documents will not be accepted, regardless of the reason.
- Upload both documents through the “Upload Eligibility Documentation” tab on the settlement website.
- Or mail them to: Kacin v Ohio BMV, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391.
What would the refund cover?
The refund is available only if the Court grants final approval, the documents are submitted on time, and BMV can confirm eligibility from its records.
- The refund covers the plate’s purchase price and sales tax.
- It does not cover separate services bought at the same time, such as plate personalization.
What happens if I do nothing?
Being bound means you give up the ability to bring claims against BMV and the other released parties that concern the fees for these Specialty Military License Plates.
- You will remain bound by the settlement.
- You will not receive a refund through the settlement if you do not submit Eligibility Documentation.
How do I opt out, and what does that change?
Opting out means leaving the settlement. You will not receive settlement benefits, but the settlement will not bar your own claims, if any, concerning the released claims. An agent or attorney generally cannot sign an opt-out request for you; the notice lists limited exceptions for an estate representative and certain powers of attorney.
- Send a signed opt-out letter that the Settlement Administrator receives by December 2, 2026.
- Include your full name, address, telephone number, the case name, and the required statement about your purchase, VA disability status at the time of purchase, and no previous BMV refund.
What do I need to do if I want to object but stay in the settlement?
An objection does not remove you from the settlement. You remain in the Settlement Class and will be bound if the Court approves the settlement despite your objection. The notice says an objection must be filed with the Court and sent to Class Counsel and BMV’s counsel.
- You must submit a written, signed objection by December 2, 2026.
- It must state your objections and reasons, include any supporting evidence, identify whether you plan to appear at the Settlement Fairness Hearing, and provide the other information listed in the notice.
