AdaptHealth North Carolina Debt Collection Settlement

This proposed settlement concerns claims that AdaptHealth used improper debt-collection practices involving certain medical equipment accounts in North Carolina. Eligible Class A members must file a claim. Eligible Class C members who received notice are paid automatically unless they opt out; people who did not receive notice but believe they belong in Class C must file a claim. The Court has preliminarily approved the settlement but has not yet made a final approval decision.

What are the two classes, and what is different about them?

  • Class A covers certain people who were billed for equipment they allegedly had returned, rejected, or never received. Its dates of service run from April 3, 2019 through April 3, 2025.
  • Class C covers certain people sent a “Seriously Past Due” or “Final Demand” letter suggesting possible legal action. Its associated dates of service run from April 3, 2019 through March 31, 2026.
  • For either class, the person must have lived in North Carolina at the relevant time and must be among the people identified in AdaptHealth’s records. The notice also lists exclusions, including timely opt-outs and AdaptHealth-related people and entities.
  • The notice does not say whether someone who qualifies for both classes can receive both class payments; contact the Settlement Administrator about overlapping eligibility.

Do I need to file a claim?

  • If you are an eligible Class A member, you must submit a valid Claim Form to receive the $3,500 payment.
  • If you are an eligible Class C member who received a notice by mail or email, you do not submit a Claim Form. The payment is automatic unless you exclude yourself from the settlement.
  • If you believe you belong in Class C but did not receive a notice, you must submit a valid Claim Form to seek a payment.

What does the notice require for a claim form?

  • The form may be submitted online or mailed to the Settlement Administrator.
  • It must be submitted or postmarked by December 8, 2026.
  • The notice says a claim must be on time, fully completed, contain all required information, and be signed. It does not list particular supporting documents in the notice.

How much are the payments, and could there be an additional payment?

  • Class A has a $1,624,000 fund. Eligible members with valid claims are to receive $3,500 per person.
  • Class C has a $6,700,000 fund. Eligible people who received notice are to receive $47 per person automatically; eligible people without notice must make a valid claim.
  • If money remains after the initial payments, an additional proportional distribution may be made where applicable. That additional payment is not promised.

What happens if I do nothing?

  • Class A members who do nothing will not receive a payment.
  • Class C members who received a notice will receive their payment automatically if they do not exclude themselves.
  • Class C members who did not receive a notice will not receive a payment unless they submit a valid claim.
  • In each situation, a person who does not opt out remains in the settlement and gives up the right to bring or continue a separate lawsuit against AdaptHealth about the claims resolved here.

What does opting out mean, and what must I do?

  • Opting out means leaving the settlement. You will not receive a settlement payment, but you keep the right to pursue your own case about the released claims at your own expense.
  • You must mail a signed written exclusion request. It must identify the class or classes you want to leave and include your contact information and AdaptHealth account number.
  • The request must be postmarked by December 8, 2026.

How can I object, and do I have to attend the hearing?

  • An objection asks the Court not to approve some or all of the proposed settlement. You can object only if you remain in the settlement.
  • A written objection must be filed with the Court or mailed to the Clerk of Court by December 8, 2026. It must explain the objection, identify the class or classes involved, and include the required contact and account information and signature.
  • The final approval hearing is scheduled for January 20, 2027 at 2:00 p.m. ET. You do not have to attend for a timely written objection to be considered.

When will payments be sent?

  • The settlement is proposed and has been preliminarily approved, but the Court still must decide whether to grant final approval.
  • Payments are to be sent only after final approval and after any appeals have been resolved. The notice does not give a payment date.
