Who is included in the Settlement Class?
The settlement covers people or organizations that made a purchase, sale, or exchange of Mexican peso-denominated Mexican government bonds with a Defendant or a Defendant’s affiliate between January 1, 2006 and April 19, 2017. They also must either have been based in the United States or its territories, or, if based elsewhere, have made the transaction in the United States or its territories.
The notice excludes Defendants and related people and entities, as well as the U.S. and Mexican governments. An Investment Vehicle is not excluded just because it is considered affiliated with a Defendant, but a Defendant and its related entities cannot collect from the fund through an Investment Vehicle.
How much money is available, and how will payments be figured out?
The settling defendants agreed to pay $86.4 million in cash. Interest may be added. Before payments are made, the fund may be reduced for taxes, notice and administration costs, court-approved attorneys’ fees and expenses, service awards, and other court-approved costs.
The notice does not state an individual payment amount or explain the payment formula. It says eligible claimants will receive distributions under the Distribution Plan.
Do I need to submit a new claim form, and what proof is required?
If you timely submitted a valid Proof of Claim and Release for the April 21, 2021 notice concerning the Barclays and JPMorgan settlements, you do not need to submit another claim form for this settlement.
If you did not submit that earlier claim, you must submit a valid, timely Claim Form and qualify as an Authorized Claimant to seek a payment. The notice says the Claim Form contains instructions, but it does not state in the notice itself which supporting documents are required. Read the form carefully when completing it.
When and how do I submit a claim?
People who need to file a new claim may submit the Claim Form online or mail it to the Settlement Administrator. The deadline is January 4, 2027. Mailed forms must be postmarked by that date.
A person who did not file the earlier claim and misses this deadline ordinarily cannot receive money from the Net Settlement Fund, although the Court may approve a late claim.
What happens if I do nothing, and what does it mean to exclude myself?
If you stay in the Settlement Class and the settlement becomes final, you give up the right to bring or continue certain claims against the settling defendants and other released parties about the conduct covered by the case. This applies even if you do not submit a claim form and receive no payment.
You can leave the settlement by mailing a written Request for Exclusion that is postmarked by October 29, 2026. Leaving means you cannot receive money from this settlement, but you will not be bound by this settlement’s release and may pursue your own claims at your own expense.
What must an exclusion request include?
To exclude yourself, send a signed written Request for Exclusion by the required mailing method. It must include your contact details, any trade or business names to be excluded, the case name, a certification that you are a class member, details of the relevant bond transactions, and a statement requesting exclusion.
The request cannot be made by phone or email. It must be mailed to the Settlement Administrator and postmarked by October 29, 2026.
Can I object to the settlement?
If you remain in the class, you may object to the settlement, the Distribution Plan, attorneys’ fees and expenses, or service awards. A written objection must be filed with the Court and served on Lead Counsel and counsel for the settling defendants by October 29, 2026.
The objection must be signed and include the specific reasons and supporting material, transaction details, and other information listed in the notice. A person who validly excludes themselves cannot object.
When is the court hearing, and when would payments be made?
The Court has scheduled the Fairness Hearing for December 3, 2026 at 3:00 p.m. It is currently planned as a telephone hearing. The Court will consider whether to approve the settlement and the request for attorneys’ fees and litigation expenses.
The date, time, or format may change. The notice does not give a date when payments will be sent. Any distribution depends on final approval and the later distribution process.
