Questions & Answers

Who is covered by this settlement?

Who is covered by the settlement?

  • The settlement covers hourly, non-exempt people employed by Menasha or assigned to work at Menasha in California between January 15, 2017 and September 15, 2024.
  • Temporary workers assigned through Simplified Labor Staffing Solutions or other staffing agencies may be included.
  • The separate PAGA payment group covers people who worked during July 31, 2018 through September 15, 2024.

Do I need to file a claim to get paid?

Payments are automatic for eligible people. Keep the administrator updated if your mailing address changes.

  • You do not need to submit a claim form to receive a payment.
  • If you do not opt out of the Class Settlement, the administrator will mail one check to your notice address. It combines your Class Payment and PAGA Payment if you qualify for both.
  • A person who opts out can still receive a PAGA payment if they are an Aggrieved Employee, but will not receive a Class Payment.

How are the Class and PAGA payments calculated?

The notice lists estimated payments, but actual amounts can change. A person who worked in both class-payment periods has workweeks counted under each period's separate calculation.

  • The Class Payment comes from the Net Settlement, meaning the money left after court-approved fees, costs, representative awards, administration costs, and the PAGA allocation.
  • For work performed from January 15, 2017 through January 16, 2022, 80% of the Net Settlement is divided among participating class members based on their workweeks in that period.
  • For work performed from January 17, 2022 through September 15, 2024, 20% of the Net Settlement is divided based on workweeks in that later period.
  • The PAGA Payment is separate. The $18,750 individual PAGA allocation is divided according to PAGA Period workweeks.

What if the workweeks on my notice are wrong?

Documents are required only if you challenge the workweek numbers used for your payment calculation; they are not required to receive an automatic payment.

  • Your notice lists the Class Period and PAGA Period workweeks credited to you.
  • To dispute those numbers, send the administrator a signed letter by November 21, 2026. You may use mail, email, or fax.
  • Include copies of pay stubs or other records that support different workweeks. Do not send originals because they will not be returned.
  • The administrator's decision on a workweek challenge is final under the notice.

What changes if I opt out of the Class Settlement?

Only people who stay in the Class Settlement may submit an objection to the settlement.

  • Opting out means leaving the Class Settlement. You will not receive an Individual Class Payment.
  • By opting out, you preserve the right to personally pursue Class Period claims against the Companies or staffing companies that assigned you to Menasha.
  • You cannot opt out of the PAGA part. If you are an Aggrieved Employee, you remain eligible for an Individual PAGA Payment and give up the PAGA claims released by the settlement.

How can I object, and when is the court hearing?

The Final Approval Hearing is scheduled for February 9, 2027, at 10:00 a.m., in Department 10 of the Los Angeles Superior Court, 312 North Spring Street, Los Angeles, California. The court could reschedule it.

  • A written objection must be sent to the administrator by November 21, 2026.
  • The objection should identify what you disagree with, why, and supporting facts. It must identify the case and include your name, current address, telephone number, approximate employment dates, and signature.
  • Participating Class Members may also object at the Final Approval Hearing, personally or through a lawyer they hire at their own expense.

When might payments be sent, and what happens if I do not cash my check?

The notice does not promise payment unless the settlement receives final approval and the required funding occurs.

  • The settlement is still awaiting final court approval.
  • If it is finally approved, the Companies must fund the settlement no later than 20 days after the judgment becomes final. That date can be later if there is an objection or appeal.
  • The notice does not provide a specific date when checks will be mailed.
  • Each check has a void date. If it is not cashed by that date, the money is sent to the California Controller's Unclaimed Property Fund in your name.

How does the notice describe taxes on payments?

Tax treatment can differ by payment portion. Consider consulting a tax adviser if you have questions about your own tax situation.

  • Twenty percent of an Individual Class Payment is designated as wages and is subject to withholding and reported on a W-2.
  • The remaining 80% of the Individual Class Payment and Individual PAGA Payments are reported on 1099 forms under the notice.
  • The notice says it does not provide personal tax advice.
