Roberts v. Long Beach Community College District Settlement

This proposed wage settlement concerns allegations that Long Beach Community College District did not pay part-time instructional faculty minimum wages for all hours worked. Eligible faculty members who remain in the settlement receive an automatic payment; those who opt out do not receive a payment but keep the right to pursue their own Class Period wage claims.

Who is included, and do I need to file a claim?

  • The settlement covers part-time hourly instructional faculty who worked for Long Beach Community College District from April 5, 2019 through August 25, 2025.
  • No claim form is required. A class member who does not opt out receives an automatic payment.

How is my payment calculated?

  • The $18 million gross fund is reduced by Court-approved fees, expenses, service awards, and administration costs.
  • The remaining amount is divided using each participating person’s weighted Weekly Credit Hours.
  • The parties ask the Court to approve treating half as wages and half as liquidated damages and interest.

What if the Weekly Credit Hours on my notice are wrong?

  • Send the Administrator a signed challenge by mail, email, or fax by December 3, 2026.
  • Include copies of pay stubs or other records showing the different hours. Do not send originals.

How do I opt out?

  • Send a personally signed written request to the Administrator by December 3, 2026.
  • A person who opts out receives no payment but keeps the right to pursue covered wage claims separately.

How can I object or attend the hearing?

  • Send a signed written objection to the Administrator by December 3, 2026.
  • The final approval hearing is scheduled for February 9, 2027 at 10 a.m. in Department 11 of the Los Angeles Superior Court, with a virtual option described in the notice.

When will checks be mailed?

  • Checks are mailed after final approval and any appeal. The notice does not give a specific payment date.
  • If your address changes, notify the Administrator. A voided check is sent to California’s Unclaimed Property Fund in the recipient’s name.
