Le Moyne College Spring 2020 Tuition Settlement

The notice was sent based on Le Moyne’s records, but receiving it does not by itself guarantee a payment.

• You may be included if you were a Le Moyne undergraduate who was charged tuition and/or Mandatory Fees and took at least one in-person, on-campus class in Spring 2020.
• The notice says people are not eligible for settlement proceeds if they started the semester in online-only classes, paid no tuition or fees, or left Le Moyne before March 1, 2020.
• You must also stay in the settlement rather than opt out to receive money.

• Each Class Member who does not opt out is to receive an equal share of the Net Settlement Fund.
• The notice does not state a fixed payment amount. Your estimate depends on the Net Settlement Fund and the number of Class Members who do not opt out.
• The $243,206 settlement amount is not all available for class payments. It also funds notice and administration, and may cover Court-approved attorney fees, costs, expenses, and a service award to the named plaintiff.

The notice says mailed checks and electronic payments will be made after the Court approves the settlement. It does not give a specific payment date.

• You do not need to file a claim or send supporting documents to receive a mailed check.
• If you want electronic payment instead, complete, sign, and submit the Election Form online or mail it to the Settlement Administrator by October 19, 2026.
• The form must be completed by the Class Member or someone legally authorized to act for that person. A late or incomplete form may delay payment.

• To leave the settlement, mail a signed Opt-out Statement by First Class U.S. Mail, postage prepaid, to the Settlement Administrator.
• Include your name, address, telephone number, and a statement that you intend to opt out.
• It must be postmarked by October 19, 2026.
• If you opt out, you will not receive settlement money and cannot object to the settlement. If you stay in the settlement, the notice says you give up claims against Le Moyne that were or could have been brought in this case.

• You may object only if you do not opt out.
• Mail a written objection to the Settlement Administrator, postmarked by October 19, 2026.
• The notice requires detailed information, including your contact information, why you say you are a Class Member, the reasons and support for your objection, and your signature. It also requires additional information about any lawyer helping with the objection and prior class-action objections.
• You may attend the Final Approval Hearing, but the notice says you should state in your objection whether you intend to appear. The Court may consider a timely mailed written objection even if you do not attend.

The hearing date is not a promised payment date. The notice does not say when payments will be sent after final approval.

• The Court has given preliminary approval, not final approval.
• The Final Approval Hearing is scheduled for December 17, 2026, at 11:00 a.m., at 401 Montgomery St, Syracuse, New York 13202.
• At that hearing, the judge will consider the settlement and any properly raised objections, then decide whether to approve it.

• Class Counsel plans to ask the Court for up to $81,068.66 in attorney fees and up to $20,000.00 in costs and expenses.
• The named plaintiff may receive up to $2,500 for work on the case, in addition to his share as a Class Member.
• The Settlement Administrator may seek up to $24,990 for its work. These amounts are paid from the Cash Settlement Fund and are subject to Court approval where the notice says approval is required.
