Can I receive both cash payments, and can I add credit monitoring?
The two cash options are alternatives. Credit monitoring is an additional benefit, not a replacement for the cash choice.
- Choose Cash Payment A for reimbursement of documented losses, up to $5,000, or Cash Payment B, an estimated $20 payment. You cannot receive both cash payments.
- The estimated $20 can go up or down depending on the number of valid claims.
- You may also choose one year of one-bureau credit monitoring in addition to either cash option.
What must I provide to request reimbursement for documented losses?
Cash Payment A may reimburse up to $5,000 in documented losses related to the Data Incident. A signature or statement by itself is not enough; the notice requires reasonable supporting documentation.
- Select Cash Payment A on the Claim Form.
- Attest under penalty of perjury that you had documented losses related to the Data Incident.
- Provide reasonable documents supporting those losses.
- Do not claim expenses already repaid by another source in connection with the identity-protection and credit-monitoring services offered in Defendant’s notification letter, or otherwise.
What does the credit-monitoring benefit include?
The notice offers one year of monitoring from one credit bureau. The supplied notice does not state whether documents are needed to request this benefit; it does state that a valid and timely Claim Form is required to receive settlement benefits.
- The product includes medical identity monitoring and real-time alerts.
- It includes insurance coverage of up to $1 million for medical identity theft.
- The notice says it is available even if you previously received credit monitoring related to this incident or for another reason.
- The notice estimates its value at $240 per year.
How do attorneys’ fees and other court-approved payments affect the settlement fund?
This means the $250,000 is the total settlement amount, rather than a separate amount reserved entirely for class-member payments.
- The defendant will pay $250,000 if the Court approves the settlement.
- Class Counsel may ask for up to $150,000 in attorneys’ fees and up to $15,000 in costs.
- The two Class Representatives may each receive a $2,500 service award if approved.
- Any approved fees, costs, and service awards come out of the $250,000 settlement amount before payments to people with valid claims.
When could benefits be distributed?
The notice does not promise a payment date. It says benefits will be distributed as soon as possible only after final approval and after any appeals have been resolved.
- Benefits are not expected before final approval and the end of any appeals.
- The Final Approval Hearing is scheduled for January 25, 2027, at 10:00 a.m. ET.
- The notice says the hearing date and time can change.
- The supplied notice says the hearing is via WebEx but does not provide connection information.
What must an opt-out request include?
Opting out means leaving the settlement. According to the detailed opt-out section, a person who opts out does not receive settlement benefits and keeps the right to separately sue about the legal issues in this case.
- Send a written exclusion request to the Settlement Administrator.
- Include your name, address, telephone number, email address if you have one, a statement that you want to be excluded, and your own signature.
- Mail it to the administrator and have it postmarked by December 24, 2026.
