No-Proof OptionMonitoring New

Claims open Deadline: December 21, 2026

Who qualifies?

You qualify if you are a U.S. resident whose private information was affected by the September 2023 Hospital Español Auxilio Mutuo data incident. Eligibility is not limited to Puerto Rico residents.

How much could I receive?

Choose up to $2,500 in documented eligible losses or a $25 alternative payment. Two years of credit and medical monitoring are also available. Cash payments may be reduced proportionately if the settlement cap is exceeded.

Do I need supporting documents?

Loss claims require supporting records; the $25 alternative does not require loss documents. Monitoring is available through the enrollment process without filing a cash claim.

Do I need a notice ID or PIN?

The online cash form requires your class member ID; the paper form’s ID rule is not established in the saved materials. Monitoring uses a separate unique enrollment code, which you can request from the administrator if missing.

What is the deadline?

Submit online by 11:59 p.m. on December 21, 2026, or postmark a mailed claim by that date. The saved materials do not specify the time zone for online filing.

How do I claim?

File the online or mailed claim for your chosen cash option and attach loss records if applicable. To obtain monitoring, follow the separate enrollment-code instructions rather than assume a cash claim enrolls you automatically.

Who may be included in this settlement?

Who is included in the settlement?

  • The class covers people living in the United States whose personal information may have been accessed or acquired in the cybersecurity incident involved in this case.
  • The defendant, people who timely opt out, the assigned judges and their staff and families, and certain people held criminally responsible for the incident are excluded.

What cash payment can I claim?

The two cash-payment options are alternatives, not separate payments you can stack.

  • You can claim up to $2,500 for qualifying out-of-pocket losses, or choose a $25 flat cash payment.
  • You cannot receive both cash-payment options.
  • Both options are subject to the $500,000 total cap for monetary benefits. Payments may be reduced proportionally if claims exceed that cap.

What do I need to claim reimbursement for out-of-pocket losses?

The higher payment is for documented out-of-pocket losses, up to $2,500. The notice does not promise the full amount; monetary payments can be reduced under the overall cap.

  • The loss must be an actual, unreimbursed monetary loss and more likely than not caused by the data incident.
  • It must have occurred between September 2023 and December 21, 2026.
  • You must have made reasonable efforts to avoid the loss or obtain reimbursement, including using available credit-monitoring and identity-theft insurance.
  • Submit a valid claim form with receipts or other third-party records. Documents you prepared yourself, such as handwritten receipts, are not enough by themselves.

Do I need receipts or other documents to claim the $25 payment?

The $25 payment is the alternative to a claim for documented losses. It is not an additional payment.

  • Submit a valid claim form.
  • No documentation is required for this option.

What are the credit and medical monitoring services, and how do I enroll?

The notice describes monitoring as an opportunity available in addition to one of the cash-payment choices for class members who remain in the settlement.

  • The monitoring is one-bureau credit and medical monitoring through CyEx for two years.
  • It includes at least $1 million in fraud protection.
  • No claim form is needed for this benefit.
  • After final approval, enrollment uses the unique code in the mailed notice. A person who lacks a notice or code can contact the Settlement Administrator.

How and when do I submit a claim for a cash payment?

A valid and timely claim form is required for either cash-payment option.

  • File online by 11:59 p.m. on December 21, 2026, or mail the form so it is postmarked by December 21, 2026.
  • Mailed claim forms go to: Hospital Español Auxilio Mutuo De Puerto Rico, Inc. Data Incident, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391.

When would settlement payments be sent?

The settlement is proposed, not yet final. Filing a claim does not establish when payment will arrive.

  • Benefits will be distributed only after final approval and after any appeals are resolved.
  • The final approval hearing is scheduled for January 20, 2027, but appeals may delay payment. The notice does not give a specific payment date.

How do I opt out, and what happens if I do?

Opting out means leaving the settlement. It is different from objecting to it.

  • To leave the settlement, mail a written request for exclusion by December 21, 2026.
  • The request must state that you want to be excluded, include your full name and current address, and contain your personal signature.
  • If you opt out, you receive no settlement benefits but keep the right to sue the defendant separately about the claims resolved here. Group opt-outs are not allowed.

How do I object to the settlement?

An objection tells the Court what you think should not be approved. It does not remove you from the settlement.

  • You may object only if you stay in the settlement; a person who opts out cannot object.
  • The objection must be filed with or mailed to the Court by December 21, 2026. A copy must also be sent to class counsel, defense counsel, and the Settlement Administrator by that date.
  • The notice requires identifying information, specific reasons for the objection, supporting documents, attorney information if applicable, a statement about whether you intend to attend the hearing, proof that you are in the class, and signatures.

What does the notice say about monitoring if I do nothing?

  • The notice is internally inconsistent. Its opening and Question 13 say class members who do not opt out have an opportunity to enroll in monitoring, while Question 20 says a person who does nothing receives no settlement benefits.
  • Because the notice does not resolve the conflict, contact the administrator before relying on either statement.
