Who is covered by the settlement?
The settlement is limited to certain Allstate policyholders with Arizona structural-loss claims. Receiving the notice means you were identified as likely to be in the class, but you still must submit a valid claim form to seek payment.
- Your claim must involve structural damage to property in Arizona while it was covered by an Allstate property policy.
- Allstate must have made an actual-cash-value (ACV) payment using an Xactimate estimate, and that payment must have withheld nonmaterial depreciation.
- The relevant period is based on the date of the initial ACV payment, not necessarily the date of the damage.
- Some claims are excluded, including claims under policy language that expressly permits labor depreciation, claims that used up the applicable insurance limits, and claims denied or abandoned without an ACV payment.
What payment could I receive?
The payment category depends on whether nonmaterial depreciation remains unpaid or whether all outstanding depreciation was already recovered through the claim process. You must submit a valid claim form for the settlement to determine eligibility and payment amount.
- If all nonmaterial depreciation was not previously paid, the settlement amount is 50% of the net estimated amount withheld and not later paid, plus 10% simple annual interest from the initial ACV payment through the settlement’s Effective Date.
- If all outstanding depreciation was recovered through the insurance claim process, the notice instead provides a one-time payment between $10 and $360. The amount depends on the nonmaterial depreciation withheld.
- The notice describes these payments based on a person’s claim history; it does not describe them as benefits that a person may choose between.
How do I submit a claim, and do I need documents?
A claim form is required. The notice gives two ways to file: mail or online. It does not specify supporting-document requirements for an ordinary claimant, so the notice alone does not say whether records should be attached.
- Complete and return a truthful and accurate Claim Form.
- You may submit the form online or mail it to the Settlement Administrator.
- A mailed form must be postmarked by January 29, 2027. An online form must be submitted before midnight Mountain Standard Time on January 29, 2027.
- The notice does not say that an ordinary claimant must send loss records or other supporting documents. It does require written proof of legal authority if someone signs as a Class Member’s representative.
When would payment be sent?
The notice says payments will be mailed to eligible Class Members only after final approval, favorable resolution of any appeals, and completion of the claims process. It does not promise a particular date.
- Payment depends on the Court granting final approval.
- Any appeals must be resolved in favor of the settlement.
- Claims administration must be completed before payments are mailed.
- The notice does not give a specific payment date.
What happens if I opt out?
Opting out means leaving the settlement. This is the option for someone who does not want a payment from this settlement and wants to retain the right to sue Allstate individually over the claims this case resolves.
- To leave the settlement, mail a signed exclusion request with your full name and address by November 16, 2026.
- You cannot opt out by phone, email, or the settlement website.
- A person who opts out cannot receive a settlement payment but keeps the ability to pursue their own lawsuit about the claims resolved by this settlement.
- The request ordinarily must be made individually. A representative may act for a deceased or incapacitated Class Member, but must provide written proof of legal authority.
How can I object or speak at the hearing?
An objection tells the Court why you disagree with the settlement. It is different from opting out: an objector stays in the class and will still be bound if the Court approves the settlement.
- File a written objection with the Mohave County Superior Court and mail a copy to the Settlement Administrator by November 16, 2026.
- The objection must identify the case, give your full name and address, explain your specific reasons, and state whether you plan to attend the Final Approval Hearing.
- To speak at the hearing about an objection, you must also file a notice of intention to appear and mail copies to Class Counsel and Allstate’s counsel by November 16, 2026.
- You may object only if you remain in the settlement class; a person who opts out cannot object.
