P.I.T. Retrievals v. HealthPort Medical Records Settlement

This proposed class settlement concerns certain charges for medical records requested from Pennsylvania healthcare providers or facilities for life or health insurance applications. People who qualify must submit an online claim to seek payment. Staying in the class without opting out may release related claims if the Court approves the settlement.

P.I.T. Retrievals v. HealthPort Medical Records Settlement
New

Who qualifies for this settlement?

  • The request must have been for records from a Pennsylvania healthcare provider or facility in connection with a patient’s life or health insurance application.
  • The requester must have paid HealthPort more than the specified maximum basic, search and retrieval, and/or reproduction fees, and not have been charged an agreed-upon rate.
  • The request must fall between December 17, 2009 and July 23, 2026.
  • Certain people are excluded, including present or former counsel for HealthPort in this litigation, the Court and its immediate family and staff, and Class Counsel.

What could a valid claim pay?

  • A qualifying claimant may receive 67.5% of the alleged overpayment for applicable basic, search and retrieval, and per-page copying charges.
  • The Settlement Administrator determines the alleged overpayment and payment amount for each request.
  • HealthPort’s records are used to identify requests, payments, and the calculated benefit.

How do I ask for a payment?

  • Use the unique Class Member ID to access the online Proof of Claim and review the transactions HealthPort attributes to the class member.
  • Complete, sign, and submit the Proof of Claim through the settlement website.
  • The completed online claim must be received by December 31, 2026.

Do I need to submit receipts or other documents with my claim?

  • The notice requires a properly completed and signed Proof of Claim.
  • It says the online claim includes transaction information from HealthPort’s records.
  • The notice does not state whether claimants must also provide receipts, invoices, or other supporting documents. That requirement is unspecified in the notice.

When would payments be sent?

  • Payment depends on the Court approving the settlement.
  • Appeals may follow approval and can delay payment, possibly by more than a year.
  • The notice does not provide a specific payment date.

How do I leave the settlement instead of staying in it?

  • Send a written exclusion request by First Class Mail, postage prepaid, so it is received by the Settlement Administrator by November 16, 2026.
  • The request needs the case reference, Notice ID, the capacity in which the request is made, contact information, a statement asking to be excluded, and a signature.
  • Each class member needs a separate request. Phone and email exclusions are not accepted.
  • A person who opts out cannot receive a settlement payment, but is not bound by the settlement.

What happens if I do nothing?

  • If a class member stays in the class and the settlement is approved, they cannot sue or continue a lawsuit against HealthPort about claims that were or could have been raised in this case.
  • Doing nothing does not result in a settlement payment.
  • To keep the right to pursue those claims separately, a class member must exclude themselves by the stated deadline.

Can I object without leaving the settlement?

  • Only people who remain in the class may object.
  • A written objection must be filed with the Court and mailed to Class Counsel and HealthPort’s counsel so it is received by November 2, 2026.
  • The objection has detailed content requirements, including the objector’s information, the reasons for the objection, whether the person plans to attend the hearing, and any planned witnesses or documents.

Do I have to attend the Court hearing, and can I speak?

  • The Fairness Hearing is scheduled for December 1, 2026, at 12:00 PM, in Room 816 of the City County Building, 414 Grant Street, Pittsburgh.
  • Attending is not required.
  • A person who wants to speak must file and mail a written Notice of Intent to Appear so it is received by November 2, 2026. A person who opted out cannot speak at the hearing.

Will Class Counsel’s fees reduce class-member payments?

  • The notice says HealthPort will pay Class Counsel’s fees, costs, and expenses separately from the relief available to class members.
  • Class Counsel plans to request up to $65,906.80 for fees and costs. The Court may award less.
  • The notice also says Class Counsel will request a $2,500 service payment for P.I.T. Retrievals, LLC.
