Questions & Answers
Who is included in the settlement class?
You may be included if your cell number, or another number you were charged to receive calls or voicemails on, was one of the 41,719 numbers in the expert report. The call or voicemail must have been placed by Cody Folsom, Folsom Insurance Agency LLC, or an agent, during the stated period, and must have used the same or a substantially similar prerecorded message as the one involved in the lawsuit.
How much could a payment be?
Eligible people who file a timely valid claim may receive an equal share of what remains of the $850,000 fund after notice and administration costs, attorneys’ fees, and litigation costs and expenses are deducted.
The notice estimates a payment of $125 to $200 per participating class member. That is only an estimate: the final amount can be higher or lower depending on how many valid claims are approved.
How do I submit a claim, and is proof required?
Submit a valid claim online by November 16, 2026, or mail it to the Claims Administrator with a postmark no later than that date.
The notice requires a valid, approved claim form. It does not say whether supporting documents must be provided with the form, so the document requirement is unspecified in this notice.
What happens if I do nothing?
You must submit a claim to receive money. If you do nothing, you will not receive a share of the settlement fund.
If you are in the settlement class and do not exclude yourself, you still give up the covered TCPA and related state-law claims against Folsom Insurance Agency if the settlement is approved.
How do I exclude myself from the settlement?
Excluding yourself means leaving the settlement. You will not receive a payment, but you will not give up the covered TCPA and related state-law claims described in the notice.
- Mail a written exclusion request to the Claims Administrator, postmarked by November 16, 2026.
- Include your full name, address, the telephone number that was called, and a clear statement that you want to be excluded.
- Sign the request yourself. Someone signing for you must attach a power of attorney.
When might payments be sent?
The court is scheduled to consider final approval on December 29, 2026, at 10:00 a.m. CT. You do not have to attend.
If the court grants final approval, checks are to be mailed within 30 days after the judgment becomes final. An appeal can delay payment.
Can I object to the settlement?
You may object only if you are in the settlement class and do not exclude yourself. An objection asks the court to reject the settlement; it cannot require a different settlement.
- Mail a written objection by November 16, 2026 to class counsel, Folsom Insurance Agency’s counsel, and the court.
- Include the required identifying information, your objection and its factual and legal basis, whether you plan to attend the hearing, any planned witnesses and exhibits, and your signature.
