Who is included in the settlement?
- The case concerns certain overdraft fees on debit-card purchases. The fee must have been charged when the purchase was approved while the account had enough money, but later settled when the account balance was negative, for the same purchase amount.
- The stated class period is February 23, 2019, through May 5, 2026.
- The notice says that people who received it were identified in the bank’s records as Class Members. Receiving the notice does not guarantee a payment; final court approval is still required.
How much money is in the settlement, and how is my payment calculated?
- First Federal Bank of Kansas City has agreed to create a $300,000 Settlement Fund.
- The amount available for Class Member payments will be less than $300,000 because the fund also pays approved attorneys’ fees and costs, any approved $5,000 Service Award for the Class Representative, and settlement-administration costs.
- The notice does not state an individual payment amount. It says the remaining Net Settlement Fund will be allocated under formulas in the Settlement Agreement.
Do I need to file a claim or send proof to get paid?
- No claim form is required.
- You do not need to submit supporting documents to receive the automatic payment or credit described in the notice.
- Do not opt out if you want to remain in the settlement. The Court must approve the settlement before payments or credits can be issued.
Will I receive a check or an account credit?
- If you are a current customer, the notice says your payment will be credited to your account.
- If you are a former customer, the Settlement Administrator will send a check.
- If your address has changed, contact the Settlement Administrator so it has the right address for payment purposes.
When could payments or account credits be sent?
- The final approval hearing is scheduled for October 1, 2026, at 1:30 p.m.
- If the Court approves the settlement, payments or account credits are expected within 45 days after the Effective Date.
- An objection that succeeds means there is no settlement. An appeal can also delay payment for months or years.
What if I want to leave the settlement?
- Opting out means leaving the settlement. You will not receive a settlement payment, but you keep any right you may have to bring your own claim about the claims alleged in this case.
- To opt out, mail a letter saying that you want to be excluded. Include your name, the last four digits of your current or former account number or numbers, address, telephone number, and email address.
- The request must be postmarked by August 3, 2026, and sent to the Settlement Administrator’s Exclusions address.
Can I object to the settlement instead of opting out?
- An objection asks the Court to reject all or part of the settlement. You can object only if you stay in the settlement; people who opt out cannot object.
- Mail or send a written objection by private courier to the Settlement Administrator. It must include your identifying information, reasons for the objection and any supporting materials, information about lawyers involved, your signature, and whether you plan to attend or offer testimony.
- Your objection must be postmarked no later than August 3, 2026. If the Court overrules the objections and approves the settlement, you remain in it and may receive a payment.
Do I need to attend the final approval hearing?
- The hearing is scheduled for October 1, 2026, at 1:30 p.m. at Division 4, 415 E 12th Street, Kansas City, Missouri 64106.
- You do not have to attend. If you filed an objection, you may ask the Court for permission to speak by including the required statement with your objection.
- The notice says the hearing may be virtual, with participation instructions posted on the settlement website if that occurs.
