Who can seek a payment, and what must they do?

The settlement covers website users during the stated period. Filing a claim is required to receive a payment; being included in the settlement alone does not automatically result in payment.

  • Be in the United States and have accessed and used www.fcionline.com between September 1, 2020 and December 31, 2024.
  • Complete and submit a Claim Form by December 3, 2026. The notice says forms may be submitted online or printed and mailed.

Do I need proof or other documents with my Claim Form?

The notice does not provide enough detail to say whether documents will be needed with a claim. A signature, declaration, or notice identification alone should not be treated as documentary proof. Readers using a paper form would need to follow the form’s instructions for where and how to mail it.

  • The notice requires a completed and valid Claim Form.
  • It does not say in the notice whether claimants must provide records or other supporting documents, or what information makes a claim valid.
  • Although the notice permits a mailed paper Claim Form, the provided notice text does not give a mailing address or a postmark instruction for mailed claims.

Why is the payment only an estimate?

The $30–$60 figure is an estimate, not a guaranteed payment. The available fund is shared after the other listed settlement expenses and awards are paid.

  • Each approved claimant receives a proportionate share of the fund.
  • Class Counsel estimates about $30 to $60 per valid claim, but the actual amount depends on the number of valid claims.
  • The $375,000 fund also pays settlement administration, notice costs, attorneys’ fees and expenses, and any class representative award approved by the Court.

When and how would an approved payment be sent?

The January 13, 2027 hearing is not itself a payment date. Payment depends on court approval becoming final, any appeals process, and approval of the individual claim.

  • Payments are sent by check unless the claimant chooses PayPal, Zelle, or Venmo.
  • Checks become void 180 days after they are issued.
  • Approved claimants are to be paid 90 days after final approval of the settlement and/or completion of any appeals process.

How do I exclude myself, and what does that change?

Excluding yourself means leaving the settlement. You cannot receive settlement benefits, but you keep any rights you currently have to sue the defendant over the claims in this case.

  • Mail or deliver a written exclusion request, postmarked no later than December 3, 2026.
  • Include your name, address, signature, the case name and number, and a statement that you want to be excluded.
  • Send it to FCI Privacy Settlement, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391.

What is required to object or speak at the court hearing?

Objecting tells the Court what you disagree with while staying in the settlement. It is different from excluding yourself. The notice gives detailed requirements for an objection, including extra information about lawyers helping with it and certain prior objections.

  • You may object only if you remain in the Settlement Class.
  • File an objection with the Court and mail copies to Class Counsel and the defendant’s counsel by December 3, 2026.
  • The objection must give your reasons, identify supporting materials, include specified class-membership information, and be signed.
  • To ask to speak at the hearing, include a Notice of Intent to Appear in the objection.

What happens if I do nothing?

Doing nothing does not preserve the right to sue over the settled claims. To keep those rights, a person must exclude themselves by the deadline.

  • You will not receive settlement benefits.
  • Unless you exclude yourself, you will give up the right to bring or join another lawsuit against the defendant over the claims resolved by this settlement.
