Who is included in the settlement?
The notice describes this as a settlement for qualifying purchasers. It does not say that every person who received a notice necessarily qualifies.
- You must have had a billing address with Fashion Nova in Washington, Oregon, or California when you bought at least one product.
- The purchase must have been made on fashionnova.com or through the Fashion Nova mobile app between September 17, 2018, and May 20, 2025.
- You also must not opt out by the deadline. The notice lists exclusions for, among others, Fashion Nova and related entities, the parties’ lawyers, court personnel, and people who previously released these claims.
What does the $12 voucher cover, and what limits apply?
Each Settlement Class Member who stays in the settlement receives one $12 voucher. It is a credit for a future Fashion Nova website purchase, not a cash payment.
- The voucher may be used toward any purchase on fashionnova.com, including shipping.
- There are no product restrictions or blackout dates.
- Vouchers may be combined with one another and transferred to someone else.
- A voucher expires three years after it is issued.
Do I need to submit a claim or proof to receive the voucher?
You do not need to provide purchase records or other documents to receive this automatic voucher.
- Do not opt out if you want the voucher.
- No claim form is required.
- The voucher will be sent to the last email address Fashion Nova has on file.
- To use a different email address, contact the Settlement Administrator.
When will vouchers be sent?
Vouchers will be sent only after final approval and after any appeals are resolved. Approval is not guaranteed.
- The Court is scheduled to consider final approval on February 27, 2026.
- Even if the Court approves the settlement, an appeal may delay distribution.
- The notice does not provide a specific voucher-delivery date.
What happens if I opt out, and how do I do it?
Opting out means leaving the settlement. You will not receive a voucher, but you keep the ability to pursue the released claims yourself, subject to any defenses or arbitration rights Fashion Nova may assert.
- Mail an individual written request to the Settlement Administrator and have it postmarked by February 12, 2026.
- Include your name, address, phone number, signature, and the exact exclusion-request statement specified in the notice.
- You cannot submit a joint, class, or mass exclusion request.
Can I object to the settlement or speak at the court hearing?
You can object only if you stay in the settlement. The Final Approval Hearing is scheduled for February 27, 2026, at 1:30 p.m. PST in Vista, California, though the date may change.
- Mail a written objection to the Settlement Administrator, postmarked by February 12, 2026.
- The objection needs your contact information, the reasons for your objection, supporting materials if any, proof that you are a class member, and your signature. Additional information is required if applicable, including whether you plan to appear at the hearing.
- You may speak at the hearing only if your timely objection says that you or your lawyer intend to appear.
What rights do I give up if I stay in the settlement?
The released claims concern alleged misrepresentations or omissions about Fashion Nova sale prices, regular prices, the duration of sales or sale prices, and discount amounts.
- If the settlement receives final approval, staying in it releases claims concerning the alleged false advertising described in the lawsuit.
- The release includes both known and unknown claims of the type described.
- If you do nothing and qualify, you receive the voucher automatically but give up these claims.
