Who is included in the settlement?
The settlement covers certain people who applied for a Mercurys Madness Inc. job in Washington during the Settlement Class Period. The job posting must be one that allegedly failed to provide the pay range and/or a general description of benefits and other compensation.
The notice says Defendant’s records show that recipients are in the class. If you are unsure whether you are included, it gives the Settlement Administrator’s phone number, email address, and website for questions.
How much might I receive?
Class members who stay in the settlement are eligible for an equal share of the Class Fund. The notice estimates an individual payment of $73.31, but describes it as an estimate.
The notice says payments will be treated as non-wage damages and reported on a 1099.
Do I need to submit a claim or provide documents to receive payment?
The notice does not describe a separate claim form. It says that class members who do not exclude themselves will receive payment by mail if the settlement is approved.
To help receive payment, make sure the Settlement Administrator has your current mailing address. You can contact the administrator directly or use the optional Address Form. The notice also says to report later address or phone-number changes.
When would payment be sent?
Payment is not due unless the Court approves the settlement and it becomes final. The notice says checks will be sent after any appeals or other reviews are finished, so it does not give a specific payment date.
A check expires 180 days after it is issued.
How are attorneys’ fees and the plaintiff’s service award handled?
The settlement fund is $450,000. Class Counsel plans to ask the Court for $150,000 in attorneys’ fees, costs, and expenses, and the plaintiff plans to request a $15,000 service award. The notice says those amounts would be paid from the Settlement Fund if the Court approves them.
The Court decides the appropriate amounts and may award less than requested.
What happens if I exclude myself from the settlement?
You may leave the settlement by sending a written exclusion request that is postmarked by October 21, 2026. If you leave, you will not receive a settlement payment, but you will not be bound by the release of the claims described in the notice.
The request must include your name and address, a statement that you want to be excluded, and a signature and date. You cannot opt out by phone or email, and each person must submit an individual request.
Can I object instead of excluding myself?
An objection tells the Court why you disagree with the proposed settlement. You can object only if you remain in the Settlement Class; someone who opts out cannot object.
A written objection must be filed with the Court by October 21, 2026. The notice also requires copies of the objection and supporting documents to be mailed to Class Counsel and Defendant’s attorneys by that date. It lists detailed information that an objection must include.
