Who may qualify for a payment?
The class definition is based on signed-in MDLIVE portal use. The Facebook or Google account requirement is an additional condition for payment.
- You must have used patient.mdlive.com after signing in and engaged in activity there between May 30, 2023, and August 11, 2025.
- To receive a payment, you must also attest on the Claim Form that you had an active Facebook and/or Google account during that same period.
- Certain people and entities are excluded, including the Defendants and specified related people and entities, court officials presiding over the case and their families, and people who timely exclude themselves.
What do I need to do to request payment?
Filing a Claim Form is the only way to seek the cash payment. The notice requires an attestation, but it does not say whether supporting documents are required.
- Complete and submit a Claim Form by December 1, 2026.
- You may submit the form online or print and mail a paper form. A mailed form must be postmarked by the deadline.
- Attest on the form to the required MDLIVE portal use and active Facebook and/or Google account.
How much could I receive?
Eligible class members with valid claims may receive a cash payment of up to $15.
- The payment is up to $15, not a guaranteed $15.
- The $3.5 million Settlement Benefit Cap also covers notice and administration costs, attorneys’ fees and expenses, and awards to the named class representatives.
- The notice does not explain how the cap could affect individual payment amounts.
When and how would payment be sent?
Payment is not due unless the Court approves the settlement, the claim is approved, and any appeals are resolved.
- A check is the default payment method.
- You may choose PayPal or Venmo instead.
- Checks expire 90 days after they are issued.
What happens if I do nothing?
The full description of the claims being released is in the Settlement Agreement, not in this summary notice.
- If you do nothing, you will not receive a settlement benefit.
- Unless you exclude yourself, you will give up the right to bring or participate in claims against the Defendants that are covered by the settlement’s release.
- This applies even if you do not submit a claim.
How do I object to the settlement?
The notice includes additional requirements for people who, or whose attorneys, have made certain prior class-settlement objections in exchange for payment. Read the full objection instructions carefully if that situation applies.
- An objection tells the Court why you oppose some part of the settlement; it does not remove you from it.
- Your written objection must include your reasons, supporting materials, your name, why you believe you are a class member, information about lawyers assisting with the objection, and your signature.
- You must file the objection with the Court by November 16, 2026, and send copies to Class Counsel and Defendants’ Counsel.
- You can object only if you remain in the Settlement Class. A person who excludes themselves cannot object.
What is the final approval hearing, and do I need to attend?
The Court may change the hearing date or time. The notice says that people who timely objected and stated that they intend to appear and speak will receive notice of a change.
- The hearing is scheduled for January 6, 2027, at 9:30 a.m.
- It is scheduled to take place virtually by Zoom, using meeting ID 923-3319-0791.
- You do not have to attend. To ask to speak, you must have timely objected and included a Notice of Intent to Appear with the required information by November 16, 2026.
